Seems that this was a problem when FW 1.00.07 was introduced. Apparently this problem has come back, or maybe it was not fully fixed.
Here is an extract from the 1.00.07 release notes
"[New Features/Changes]
1. Revised the assemble RAID mechanism to avoid wrongfully degraded problem caused by abnormal shutdown."
