Yes, but that's my point - pre-release piracy is down to a leak in the distribution chain somewhere - it's hard to identify, or even point fingers, if that's a third party. But if you're within the same company then theoretically you have a reduced leak chance, so its easier to justify no-DRM on release. The versions that did go through a third party (ie retail release and other digital releases) did have DRM.

Anyone got any solid info on this?
Well you (the game developer/publisher) choose what level of integration into Steam you want - can be anything from a distribution mechanism to full steam cloud and workshop integration.

all the following just need CD keys and the CD - some you can patch to not need the CD. Or you can scan CD to a virtual drive and et voila. Working just off the HDD

    C&C Red Alert
    C&C Red Alert 2
    Quake 3
    Quake 3 Gold
    FarCry (original)
    BattleField 1942
Battlefield 2 - but it sure don't let you play LAN using the same key on 2 machines.
    Diablo
Diablo 2 (with patch as someone already mentioned)
    Baldurs Gate
Counter Strike. Needs steam, but fully playable with steam in offline mode without any hassle.

To the poster who said Crysis Warhead - what hacked version do you have? Crysis needs the CD in the machine and installs DRM to activate + check licence key. Crysis Warhead goes one further and checks validity online every time before it will start. Those definitely are DRM-tastic, albeit at the lower end of the scale.
