sports direct and there refund policy!
has anybody noticed this? i was having a random read of my reciept and i came across this...
"We are happy to offer an exchange or a gift card for any unwanted items returned within 28 days of purchase. items must be returned in their original packaging, in a saleable condition and with a receipt.
refunds will only beoffered in accordance with your statutory rights (which remain unaffected)"
now correct me if im wrong but im pretty sure that the sale of goods act over rides this statment? it really bugged me and just made me want to take my joggers back just to kick up the fuss if they wouldnt give a refund, surely this isnt right? or are they being real cheeky and doing this hoping that people dont know there rights?? :censored:

If you ordered by phone or through their website the DSR applies, but if you bought it in a shop then they can do this.

Unfortunately stores aren't legally bound to give you a refund if you don't like the product, AFAIK. Whilst your statutory rights (SAD FART - satisfactory quality, as described, fit for purpose and lasted for a reasonable amount of time) covers faulty items and so on. As they mainly sell clothes it should be obvious if it's faulty - don't buy things with holes in.
This is generally fine for things like changing a product if you didn't like the colour (but they sell the one you want) or got the wrong size - just exchange it.
The whole store is pretty shoddy to be honest, I generally know what I want and buy it from them because they're cheap and it's an in-out affair. The staff are normally thicker than a tree trunk and it tends to be full of thieving chavs and shouting parents so I avoid it like the plague.

lol well its the only thing ive bought from there and its only because i needed some joggers for my workout, but at £10 i couldnt really complain! but still it just really annoys me, it feels like there stealing the money as soon as you hand it over...hmph, dont think i will be going in there again!
and btw your right about the staff

They can't be any worse than the ones in JJB ! I've only ever been in there once and have vowed never again. I wanted to buy some new trainers, I saw a pair I liked and it took them ages to come and serve me. When they did I was presented with a moderatly trained ape, I asked for a pair of size 9's to try, he came out with 5's !!
If he'd have come out with 6's I'd have understood, he was reading the box upside down. But no, how you get 5 from 9 I have no idea (well you minus 4 lol) Anyway I sent him away to go and get the right size, he comes back with 7.5's.
I then asked the question do you actually have my size in stock ? He looked a bit red in the face and said no to which point I bid him a good afternoon and if this was the standard of training staff got in JJB I would take my custom else where.

To be honest, I'm not aware of any shop on the high street that offers a different policy. It's pretty standard.

Legally a store doesn't have to offer you a refund if you've changed your mind, even if the goods are still sealed. The fact that somes stores do just means they have a different policy to others.
Where I am working now (not for much longer) if you bring stuff back after 28 days, in some cases people bring stuff back after they've had still sealed new in a box for months we won't take it back.

As the others have said, this is a legal, standard returns policy. It doesn't prevent returns under the SoGA at all because it only applies to "unwanted" items, not faulty items.
