    JARS needs to know...

    ... we all know that JARS is too heavy on the brakes.

    Anyway late last week the plaintiff claims that a vehicle smashed in to the back of him. Apparently the driver of this vehicle claims he had to avoid being side swipped by another vehicle. However JARS has a world renouned reputation for being too heavy on the brakes. Upon impact JARS hit another vehicle in front of him.

    The question is who is at fault, or who is liable for each of the impact/damage points. Any help would be much appreciated.

    P.S. Bare in mind JARs reputation for being massively too heavy on the brakes

    my understanding is the person who hit into the back of the first person who was hit is responsible for any consequential hits as a result of the first hit.

    Jars takes some poor bloke from behind - now that sounds well inside the realms of reality to me...

    ...any attempt to befuddle the fuz with tails of 'gentle caresses down the side' should be viewed with maximum suspicion if you ask me

    It seems the gentleman who was unable to stop his vehicle from running in to the back of JARs after his heavy breaking experience left JARS a moody telephone number so all he has is a registration number.

    then the guy's in trouble, falsifying details at the scene of an accident I beleive is a criminal offense....if not it bloody well should be.

    Then again if someone gives me a number at an accident the first thing I would do is ring it to check its valid...

    There is no such thing as being 'too heavy on the brakes'. As long as break lights are functioning correctly then the emphasis is on following cars to drive with due distance and care and attention to be able to stop.

    Gentleman colliding with JARS is at fault. Providing false details will only land them in even more trouble.

    If JARS was hit from behind, regardless of if he braked heavily etc, the guy who did him up the rear (assuming it was a guy) is liable for JARS damaged rear end.

    The shunting into another person, also known as domino stacking in some circles, is a tricky one unless JARS can prove he was heartily rammed up the rear, forcing him into the person in front.

    What has happened in the past is JARS would claim on his insurance, the companies would battle it out and the guy who topped JARS would pay for the damage he caused to JARS rear whilst JARS' insurance paid for the damage to the person in front and his insurance company would try and claim it back off of the original miscreant who found JARS' rear so attractive.

    I haven't had a treble shunt for a while now, not since I last visited Brighton anwyay, so I'm not sure on the ettiqette on this one.

    I'd say let the insuarnce companies sort it out and never, ever accept liability...

    Regardless of this, the guy who started the whole chain of tailpipe bashing is at fault, even if he was trying to avoid another accident... That shows he was going too fast for the possible conditions and therefore ended up up someone's rear when he wasn't wanted there... always a nasty surprise.

    Does any of this have anything to do with the handbrake being on? ie if you're stopped with your handbrake on, if you're hit from behind, you're less likely to go into the person in front or is this just an "old wives tale"?

    But but could it be argued that JARS didn't leave a safe distance between him and the car infront maybe stopping too fast or too late - thus causing someone to rear end him.

    If JARS stopped in time, then he had left sufficient distance. If JARS hit the guy in front before the guy behind him hit him, then it would be his fault. But as it is the fault of the guy driving into the back of JARS that JARS hit the guy in front, he is liable for the accident he caused.

    That would be my understanding of it. If you've only got a telephone no. of the guy, then involve the police and give them all the details. If you've got his insurers details, then just pass it on to the insurance company and let them battle it out.

    Correct.

    I've just been through this kind of situation.

    I was stationary, the car behind me was stationary, but the next vehicle couldn't stop in time, piled into the Punto behind me, pushing that into the rear of my Clio. I was under the impression that the Punto driver would be liable for my damage, but as it turned out, it was the original driver at fault that was liable for the damage.
