well they have agreed to pick the car up on Wednesday and give us the money back but they want to pay by Cheque and take the car the same day.

That's fair enough - they would be in for a world of legal pain if the cheque bounced and they wouldn't like to pay before you returned the car.

Provided it is a business cheque you should not have much problem either way, although if you paid by card then you should really refund it to that card.
