    Just got a little run around for the missus....

    X reg Fiat Seicento 56K miles.

    It has 12 months MOT dated July 24th 2009. When we picked it up it smelt like maybe it was running a little rich on fuel but I I suppose it was to be expected. We got the car home and noticed it smelt even worse, I got on the floor and the petrol tank was leaking!

    We want to get our money back from the company but how should I approach that? And how can a car with 12 months MOT have a faulty petrol tank?

    they will say it leaked after the mot.

    theres a number on the mot sheet if you have a complaint, they may decide to come and inspect it.

    also the company you brought it from will no doubt replace the fuel tank and give you a free fill up if it has warranty.

    Might be some milage in the 'not as advertised' product description if there's a reasonable chance the car had the fault when you bought it. The company may blame the MOT station but that's between them and the MOT station.

    My car leaked after an MOT repair because the idiots didn't fit the tank properly after removing it..

    Money back might be difficult, but getting it fixed on the house shouldn't be a problem.

    Problem is the OP's Mrs won't drive the car, women can be funny about things being repaired. I know what they are like when they have a door changed on a fridge freezer, that said a car is a whole different matter.

    You have a right to a refund as the car is clearly not of merchantable quality. Unless the dealer advertised it as 'sold as seen' then you have every legal right to reject the goods.

    However, if the car is otherwise fine, you could just get them to fit a new tank and tell the missus to get over it.

    Edit to say:

    Cars with electronic fuel injection should not run rich; cars with catalytic converters doubly so. It should fail the MOT on emissions if it does.

    If you just bought it, take it back (not fit for the purpose etc.) and demand it be fixed or refunded, regardless of the MOT. Simple.

    And I'd not drive it either frankly.

    Why not? A fuel leak is not acceptable regardless of the car's age or warranty.

    It's dangerous to boot.

    well they have agreed to pick the car up on Wednesday and give us the money back but they want to pay by Cheque and take the car the same day.
