    Insurance advice

    To cut a long story short, someone backed into me at a T-junction saturday evening. On first inspection it only looked like she broke my indicator. She wants to avoid an insurance claim and says "she will pay for any damage". I get home, have a proper look and it appears that she bent my wing as well. I speak to her on the phone to tell her this.

    The next evening I drive my car at night for the first time, I notice the headlight is bent badly out of place, the second I finish the journey I text her to say that the headlight is also damaged.

    Yesterday (monday) I get a quote for the bodywork repair and today I do the same for the new headlight unit, I tell her how much she will have to pay to resolve the damage.

    She is now suggesting that I am making things up as I go along and saying she will pay for the indicator and go through insurance for everything else.

    Will this affect my insurance in anyway (ie NCB)? She claimed full responsibility and I know the accident was 100% her fault.

    I can pretty much prove she bent the wing too (as she has a dent in her car now that matches that position in relation to the towbar cap to my indicator (the cap is actually still lodged in my car), she knows about the cap, but I havent told her i noticed the dent.

    Sorry to hear about the accident

    Were there any witnesses ?

    I ask this as my mum had a similar accident a few years back, where she was queuing at a junction and the guy in front put his car into reverse instead of first and flew back into the front of her. There were no witnesses just him and her, and he said she had driven into the back of him. She tried to argue it but lost two years no-claims in the end.

    You may be able to prove that the damage was caused by impact with her car, but can you prove it was her driving backwards rather than you driving forwards ?

    My advice would firstly be to tell your insurance - it doesn't have to end up as a claim, just inform them of the accident and tell them it may be resolved without involving them, they may also be able to advise you of what to find out in case it does end up as a claim. Next get the car to a couple of accident repair centres for quotes, it's a pain but they will pick up on any damage and give you the kind of price the insurance companies will need to pay for the repair. Maybe a large accident repair specialist and a smaller more independant place - but only somewhere you can trust.

    Then contact her again and ask if she really wants it to go through insurance, tell her that you're sorry that you kept adding to the list of damage and how it must have looked so you've taken it to a couple of garages for quotes and tell her the prices. If she wants then i'd be willing to take it to somewhere she suggests to get another quote from a garage she trusts - but you don't have to use them if you don't like the look of them.

    If she still wants to go through insurance then mention that you don't want her to pay for the indicator (or anything else) herself as if it's going through insurance then everything is done through insurance - don't back down on that. Any payments you accept could be seen as a settlement payment and could seriously affect any claim.

    Insurance is complicated and tricky to sort out with accidents and this is only the opinion of how I would react in this situation, hopefully others will give their opinions too as there is no 100% right way to deal with it.

    It's a nightmare situation but I hope you get it resolved in your favour.

    Would be worth taking some photos of your car, particularly the damage and also her car, do a plan of the area, how the accident happened etc.

    ta david, yup done all that, ive written my account of the whole thing too. The worst thing at the moment is the fact I keep seeing her driving round town while using her mobile :/

    Provided your insurance company makes a full recovery of costs from the third party, you NCB will not be affected.

    The woman in question is also daft, I can see absolutely zero logic in paying for the indicator herself yet letting her insurance company pay for everything else, she may as well just do the whole thing through insurance.

    Before you go any further, contact Helphire. They are a third party accident management company - if they are satisfied its a non-fault accident, they will arrange for a courtesy car for you thats equivilent to yours, and sort all the repairs out, and bill the other parties insurer for it, not involving your insurer at all. This way, there is no question of your NCB being affected.

    You really should not get involved in liability discussions with a third party if you have an accident. Just exchange names/adresses/phone numbers and insurance details if possible. Then let your insurance company handle everything.

    Chances are that she will now only put down the broken indicator as the extent of the damage to your vehicle as that's what was originally discussed. Regardless of whether she agreed to pay for the damage, you should report the accident to your insurance company. It's just not worth the hassle of incidents like this coming back to haunt you in the future.

    This could be a tricky one as she admitted liability at the scene but is hardly likely to admit liability on the insurance claim. As she backed into you, you've got damage to the front of your car and she'll have damage to the rear of her car. You should be careful that she doesn't try and make out that you drove into her (as Barraka mentioned before me), particularly if no witnesses were present.
