Its the old xbox they won't repair. The new 360's are covered for 3 years for the RROD from memory.

How out of warranty can it be...? I bought mine on release day and it died a few weeks ago, 3 years and a couple of months after purchase. I called MS and they were quite happy to repair it under warranty, they never asked when I actually bought it at all and I didn't tell them.
It can't hurt to call them and find out.
