    Building although permission refused??? HOW?

    Run this by y'all.

    I live in a very nice little village in a converted barn.

    Next door there is a disused garage that the CO-Op bought about 5 years ago but have done nothing with.
    They sent their application to the local council which was promptly REFUSED as the parking, noise, general annoyance would be too much.

    Last Saturday, the CO-OP sent in the builders. I have found out that they cannot demolish it and build again as it was a fuel station but they can trade if the building is just renovated.

    So.......if they were refused before on the grounds stated above, and they renovate the shop, can they open and trade??? Thats the bit i dont understand.
    Surely if the shop was refused, then why renovate it as a shop (there are signs saying open beginning of Novemeber).

    Any thoughts?

    My thought is that I think my first action would be a call to the local council planning department. They should be able to tell you if this is legit or not, and if it is, on what grounds ..... but I'd be rather surprised at a Co-op going ahead if it wasn't legal to do so.

    At a guess, because it is the same building, being used for the same thing, there isn't really a lot can be done about it.

    Check on your local gov website under planning, they may have appealed the order of some change been made were they can add to the existing building.

    The other one is that they might be progressing with the building work as the planning appeal or re-application goes through. It's a risky one but you can build before you get planning permission, you just have to put it all back as it was if your planning application is refused.

    It might be that they were refused planning on the grounds of a change of use being refused, so if they've decided to go ahead and open up a CO-OP shop with a garage then there's probably little you can do.

    I think they just used the building as is, renovating but not actually doing anything that would need planning permission...sort of what happens when somones renovate your house but dont' need planning permission...
