Are Blackwell Obliged to repay my delivery costs?

Hi guys, i ordered a book from Blackwell bookstore as it was the only place i could find which done the 1997 edition of the book i needed.

I ordered it and when i received it they had sent me the newest edition without telling me. This isnt the one i needed. I ordered the correct version here at home through waterstones.

I have returned the other book to blackwell last week. It cost me £6.95 in postage. The book weighs 2.5 Kg .

So what i want to know, is blackwell obliged to give me the money it costs to return as they sent me the wrong item?

Have you ask them to refund you? Not sure if they have a legal obligation but most places refund the return postage if they sent the wrong items (places like HMV and Play)

yes i have asked them but have yet to get a reply. i thought they woud be legally obliged to do so as they didnt send the item as ordered.

Right, according to our good friend Google, the following applies

If the item is being rejectected under the Sale of Goods Act 1979 as "Not fit for purpose", then the seller is obligated to pay your return postage costs.

However, if you're rejecting the goods under the Distance Selling Regulations as "Not wanted" then you are obligated to make them available for collection, and if you choose to post them back to the supplier then they don't have to pay for that return postage.

It's possible that they think that you're just returning them under the more commonly used DSR and thus haven't done anything about your postage. This is why a covering letter is alway useful
