    I just do not understand what the criminal justice system is doing getting involved in what is quite clearly a HR issue within the company. I mean seriously wtf, and surely the woman who threw the chair at him was more guilty of a 'public order offence'.

    While it is pretty disgusting, a court case for that?? Shows what this country is coming to.

    She told him: "Your actions caused great distress, not only to the public who consume this food, but also to the company.
    That bit did make me lol though What is their definition of great distress???

    well the woman is a different matter, but i think he got off lightly! he says he through the whole bowl of salad away. i think we all know thats not true.. and the only saving grace is that he showed some remorse.

    he could have made someone seriously ill with the bacteria living in his snot (Meningococcal, streptococci) not to mention the damage he has done to the company. 2 years would be a fair sentence, although that may seem harsh i think we need to make examples of morons like him.

    He got done for it because he plead guilty...

    Had he tried to defend himself he might have gotten away with it! But the prosecution don't have to prove anything if he admits to the crime.

    If you've ever eaten at a Subway you'll know that his actions probably added something to the flavour.

    While it's pretty grim, he said he discarded it and it didn't look too fresh - though having eaten at a Subway once before, it looks old when it's new.

    He said he discarded it, and they clearly had no evidence to say otherwise. Even if he didn't discard it on what basis is this a criminal matter? Should a chef who spits on your food go to prison, do you think? It's pretty much the same thing, but to my mind the expectation would be to see such a person fired not to go to prison and certainly not for 2 years.

    and its a criminal matter because spit/snot CAN ENDANGER LIFE. its basic food hygiene.. if he took a dump in your burger, how would you feel? and if i witnessed a chef spitting in food, mine or otherwise i would probably lose my temper big time.

    the only persons spit i want in my mouth is mine or my GF

    Look, you are holding up some sort of straw man here because I never said it was ok to spit in food. that is not the issue, the issue is, should you go to jail for it?

    I think the answer is a definite no, I am astonished that you think something so trivial as this warrants ruining some young kids life as well as spending money on incarceration and court costs. I am aware that some diseases are contagious and some of them such as meningitis are very serious however I think it would require a person to know they had meningitis and then to deliberately try to infect somebody else by spitting before you could even consider a criminal case.

    I would be interested on what exactly the law they used to prosecute him was.

    why do you think its trivial? if i wiped my arse on a cheese slice in a restaurant, but then threw it away does that make it ok?

    he endangered health through being irresponsible... in exactly the same way a drunk driver gets behind the wheel, not with the intention of harming anyone but is just trying to get home.. both are irresponsible and can harm people.

    the drink driver might drive all the way home without making a single wrong turn, but the potential to indiscriminately harm is there and that is what should be punished. He works in a deli should have passed a food hygiene certificate!
