    Burgler? *POW!* Whizz!* *Biff!*

    'Av some!

    A knife-wielding burglar got the shock of his life when he was left battered and bruised by a 72-year-old former boxer.

    Gregory McCalium, 24, was punched twice in the face after breaking into the home of Frank Corti.

    The OAP said he was compelled to defend himself and his wife after McCalium threatened them at their home in Botley, Oxford.

    McCalium had thrown a knife at the pensioner - which missed. At that point the 72-year-old used his boxing skills to stop the would-be attacker in his tracks.

    Doesn't look like it, if you look closely it actually happened last year and the story doesn't mention Corti getting prosecuted.

    Surprised he didn't get put away tbh, especially with the ridiculous slant the human rights clause can be used with. I fail to forget whos better protected these days when it comes to a confrontation, the robber or the robbed.

    He should be rewarded for this kind of thing!

    I know what you mean, but that's largely an urban legend. You are allowed to use "reasonable force" to defend yourself, other people or your your property. An OAP using his fists to defend against a knife-wielding burglar a third of his age isn't just "reasonable", it's worthy of a medal.

    I'll make a little prediction - nobody in the CPS is going to be stupid enough to purse Mr Corti, even assuming that the police did bring that case forward, which I'd guess is not going to happen. And if the CPS did try it, it would get laughed out of court. The CPS would know that :-

    1) The media would have a field day at their expense. It'd probably be front page for the Daily Mail, for a start. As a journalist myself, I pray for someone to drop a story like that in my lap. It'd be birthday, Christmas put together.

    2) Its so far within the definition of "reasonable force" (unless, just possibly, there's a LOT more to the story than we've seen so far) that there'd be no realistic prospect of conviction. And one of the main criteria the CPS use in bringing a case if whether there is a realistic prospect of conviction, because if there isn't, it's a waste of their time and the court's time.

    IMHO, there's a zero chance of conviction in a criminal trial. That leaves the burglar bring a civil action. I can't imagine that qualifying for legal aid, and if it doesn't, the only way a lawyer is likely to take the case on is on an up-front fee basis, 'cos he'd know he'd almost certainly lose.


    You're correct in that defending yourself leaves you open to the possibility of action against yourself. It's a risk. But unless you want open season on householders killing intruders, so it should. But if you look at how often a householder is prosecuted for assaulting an intruder, it's a vanishingly small number and there's always a lot more to it, like Tony Martin.

    And there'll be people (like me) that wouldn't shed a tear for burglars killed by householders protecting themselves or their property. The problems, if you did have open season on burglars, include :-

    • what happens when the "burglar" turns out to be a fireman responding to a fire, so somesuch similar situation?
    • what happens when it's hubby home earlier than expected, because a job finished early and the wife mistook him for a burglar and blew him away, or brained him with a baseball bat?
    • and perhaps most seriously, burglars know what they're doing, are emotionally psyched up for it, and are probably younger and fitter than the average homeowner. And they have the element of surprise. If they know they face a good prospect of deadly force, they'll go equipped and ready for it. The result would probably be a lot of dead homeowners.


    So while I, personally, have no problem at all with homeowners using deadly force on burglars, the practical result of that policy would probably be a lot harder on homeowners than it would burglars. And most homeowners aren't going to be former boxers, martial arts experts or ex-Royal Marines (like my OAP father-in-law who, I have to admit, I would not have wanted to cross). Most homeowners, in an altercation with a young, fit burglar, would probably get their butts kicked but good.


    Householders facing prosecution for assaulting burglars is, by and large, a theoretical risk more than a realistic prospect. If injury is involved, there might well be an investigati0n, which probably involves being officially warned of the possibility of prosecution, and the strain of that alone is unpleasant enough. But by and large, neither the police, CPS nor courts are going to take a charge against Mr Corti seriously.

    Imagine what it would do to the burglar's street cred, too? Getting his butt whupped by an OAP? He'll probably have to move town because he won't be able to hold his head up high locally. Who'll be beating him up next .... pre-schoolers? Mugged by a couple of five-year-olds? I doubt he'd want to bring it all up again by trying to get Mr Corti done. I bet he'd rather forget about it as soon as possible. What a mutt!

    And Mr Corti? You rock!

    i know all about vicious older people.

    try telling one that they cant have their mobility scooter because someone booked it down for the wrong day and the rest have all gone out.

    or even that they're too dangerous to be driving the scooters and you cant hire them one.
