    Returns Question

    I buy some ram online december last year.
    It becomes faulty.

    I RMA it.

    Its found to be faulty.

    The item is no longer in stock as it has been discontinued.

    There is no like for like replacement availible and the cost of RAM has increased so whatever I want to replace it with is going to cost me more money.

    I was under the impression that the supplier should replace it with something of the same quality regardless of extra cost?

    I think your correct, they should. But some companies will try and get out of doing so if they possibly can. Who was the retailer ?

    The retailer isn't relevant at this stage, I dont want this to turn into an xyz suck you should use abc instead thread.

    I wanted to know the legalities of RMA'ing an item that has been discontinued and where there is no viable like for like replacement, I'm being told that I can either have a refund or can have another item, thing is RAM's gone up and I cant even get the cheap crap for what this OCZ stuff was..

    I've always been offered a like-for-like replacement when I've pushed for it (Scan in my case), but I've usually been quoted a ridiculous turn around time, like perhaps 6 weeks for a replacement motherboard.

    I've taken various alternative steps as a result in my RMA sequences:

    My motherboard was replaced with a like-for-like one that Scan had on site, but they put it in too small a box and damaged it, then it went back again and they put in too small a box a second time, and destroyed it. So they gave me an X48-DS3 instead of a P35-DQ6 because that was one of the only ones they had available - which placated me a touch.

    When my CPU didn't work, I was quoted another stupid amount of time for it to be replaced, IIRC, so I took a cash option and put it towards a Q9550.

    Each time I couldn't be bothered to wait any longer for a replacement, so I just went for the alternative - it was offered, but 6 weeks just wasn't reasonable in my eyes. I'm sure there are steps you can take legally, but it just didn't feel like a genuine option for me so I didn't have a lot of choice.

    Nonetheless, the point I'm making is that I've always been offered a replacement, it's just that the terms were never particularly agreeable.

    I had 2GB of OCZ Reaper HPC 8500 that broke, and when I found out how much it was going to cost to post it back to the Netherlands I just chucked it in the bin. Stupid, but it just honestly wasn't worth the hassle involved.

    Not regardless of cost, no.

    If goods don't comply with the Sale of Goods Act requirements, including "durability", then you can seek damages, and if you're a consumer, you can alternatively request either a repair or replacement. But if the cost of either of those is either simply not possible, or disproportionately expensive, then the supplier can decline to go down that route. If neither are possible and/ot disproportionately expensive, then you're back to the refund (damages) scenario, and, if that happens, the supplier may make a deduction for the the use you've had from the goods before they failed. So if, for instance, a reasonable life for an item was four years, and you'd had 18 months before it failed, the damages you'd be entitled to would, all other things being equal, amount to what was left after 18/48ths of the cost had been deducted to reflect the use you've already enjoyed.

    So there is no carte blanche for the supplier to fob you off with any old thing as they think fit, but no outright duty to simply replace or issue a full refund either.

    Or make them send it back to OCZ on your behalf and see what OCZ send you in return? They may send you a better kit, one that the retailer isn't prepared to stretch to? Worth a try.
