    Bought a faulty PS3 off Ebay, turns out its made up of broken parts

    So I bought a faulty PS3 off ebay listed as faulty, turns out though that its broken.
    No HDD or caddy, I open it up and the connector to the SD slots is broken off, loads
    of screws missing and the big obvious one the blu ray drive had been stripped and
    the cover was missing off it. I don't know what other parts are also proper borked.

    The person claims he didn't know the HDD was missing, and doesn't know about PS3's
    I haven't said anything about the insides yet.

    It was claimed that the PS3 was bought as a bundle he wanted the games from.

    The thing is looking at his past buys I think he knows more about technical things than
    he is letting on. He has bought a torx screw driver listed as for fixing a phone, an anti static
    wrist band and solder flux and a multimeter in the recent past. This to me doesn't suggest
    someone who doesn't know much about technical things or someone who wouldn't take a
    PS3 apart or even know that the HDD is missing considering how easy it is to see it.

    As I think he has conned me I feel more annoyed than I would be if someone genuinely
    didnt know.

    The thing is what should I do about it?

    Other complications, I paid in cash and didnt get a receipt annoyingly, and it doesnt seem
    its been acknowledged as paid yet (it was only yesterday) no feedback left yet.

    Depends on how he worded it. If it was just described as faulty then I think you're pretty screwed, since he never gave any details and you never asked. So, how did he word the description?

    Surely you'd only buy a faulty product if they listed the reason for the fault. If he said "the drive doesn't work, everything else is fine" then you'd have grounds to complain.

    As you've described it, it sounds like an incredibly dodgy deal on all sides...

    You bought a faulty PS3, you received a faulty PS3. He provided what was described.

    This is an eBay lesson which most people (including me) go through at some point. You wouldn't buy a car with a one-word description of "faulty" unless you knew the specific fault. Same for eBay.

    If so, didn't you notice the hard drive was missing then?

    unless you did it all outside ebay, with a Buy It Now email to end early... in which case you can't even do that!

    open a dispute with eBay, they generally take a stance of the customer is always right (rather than the seller, even with no proof sometimes), I wouldn't worry.

    Pretty much. Not quite, but pretty much.

    If it's a private sale, then as long as it is not misdescribed, then yup, caveat emptor. It could rest on exactly how it was described, because "not working" and "bits missing" are not, in my opinion, the same thing. It may well come down to whether he knew or should have known bits were missing. If it was bits obviously missing from the outside, then he could hardly fail to have spotted it. If it was something on the inside and he couldn't have known without opening it up, then ....


    At a practical level, there are three choices I can see.

    1) Complain to him. If he really didn't know, and is scrupulous, you may get your money back. But in my view ..... good luck with that one.

    2) Ebay complaints procedure. How far you'll get, especially given cash payment, I don't know.

    3) Small Claims Court. This probably is your best bet for getting your money back, but that's a long way from saying it's a good bet, just the best of a bad set of options.


    You would have to establish, I would think, that what you got was not "as described". If you bought a car described as "faulty" and it turned out the engine was missing, I think you'd have a case.

    But my old law lecturer also used to advise that private buyers should walk round the horse they were buying and make sure there was a leg on each corner, because if you didn't you wouldn't .... erm ... have a leg to stand on afterwards. Caveat emptor.

    More or less, a private buyer can be held to account for what they do say, at least where it's substantive, but not for what they don't say. And it's for the buyer to ask questions.

    And even assuming you are prepared to pay the costs of a small claims court case (which aren't huge), and put in the hassle of going through with it, and you win ... you still have the potential hassle of getting the money, which may not be cheap or straightforward.

    From the description you've given, I'd be reluctant to us the court method, because it sounds like a long shot. If the eBay method doesn't work, then I suspect it comes down to what others have said .... it's an expensive eBay lesson, and you either have to be a lot more guarded about eBay purchases, or not use it at all.

    My attitude towards eBay is that I either deal only with sellers I feel I have good reason to trust, or if it's an amount I'm prepared to risk writing off if it all goes south. Otherwise, I won't use it. But that's just me.

    I am not too bothered about the money, it's more about that I think he knew full well
    it wasn't just a faulty PS3 but a collection of physically broken parts. It went through
    ebay as a buy it now.

    I have emailed him asking why the payment hasn't been put through as paid yet though. I am
    right in thinking they need to put it through their end and it will show as paid on mine. What will
    happen eventually if he doesn't bother to put it through as paid?

    I did ask about the HDD at the time and took his word for it that he didnt know but after opening
    it up and seeing the state of it and also his buying history as I said before, I think he knew.

    Hopefully the payment will be put through then I will ask him about it and request my money back.
    I think it will end up as bad feedback as I don't want other people to be conned in this way.

    hey man this is obv a con..... he thinks hes being smart, i mean for god sake he bought solder flux, and a torex screwdriver exactly what you use to open a ps3. hes obv made a ps3 made up of all the ****ty components and sold it to you, pretending he knew nothing about it.

    i mean when you asked is the hdd missing it would have taken him a second to check and see and he didnt need to check coz he raped the machine for all its good parts and thought he pulled the wool over you're eyes, chances are the parts inside anr made of 60gb. 80gb, and 40gb elc

    as you paid cash go back to his house and tell him you are not being taken for a fool and that you want your money back. he will soon pay up lol..... why because he knows fine well that hes being a total ******.
