    canceling a phone contract

    ok, im going to give a quick run down on what my mother has gone through with this damn contract lol, she got a phone and contract with phones4you on orange, withing 1 week she needed a replacment phone! (it was duff for sum odd reason?) either way since she has had her contract she has had no end of problems, nearly every day you couldnt get hold of her, she would receive texts a day late and all sorts, turns out it was something to do with her phone again, it got sent of and repaired 3 times, there was other reasons (phone buttons failing) but im not going to get into detail here!
    So anyway she got a totaly different phone in the end, but even now its gotten worse but this time its not the phone, the orange network seems to be real crap....she cannot send and recive texts correctly, and the phone issue...well i try and ring her and go to answer phone! this is nearly EVERY time i ring her, i have to wait at least 5 mins before trying again, we demonstrated this ni the shop and the guy was shocked lol, either way orange have done nothing to help and also, they keep messing the bill up and NOT taking the direct debit! more on that, the lady who set it up got 1 digit wrong and even though my mum phoned to have it changed, they (orange) keep reverting it back to the wrong digit EVERY month....so either way she does not want the contract anymore as its pretty darn useless,

    where does she stand? are they breaching the contract by not providing her with the product? (calls and such) or is that not effective at all??? thanks for your time!

    IANAL, but yeah, sounds like she's not getting the service she paid for, so should at least be entitled to a refund until they do provide the service she bought.

    am having the same problems with orange, send them a letter asking for a refund quoting sales of goods act, they never replied, now its goign to the small claims court

    I'm pretty sure the Sales of Goods Act is incorrect to challenge the service contract and that you actually have to persue them for breach of contract for failing to provide the service that you've paid for.

    However, a couple of things that you have to check before you start. For starters, is your mum actually with Orange, or is she with an Orange reseller run by phones4you, it can be really hard to tell the difference sometimes. If it's a reseller and their customer support is ****, write directly to Orange's customer care team and you can sometimes get your network moved directly to theirs.

    If it's with them directly, then you're likely going to need to go through Small Claims court, and will need to provide a host of evidence that the service provided is unacceptable in all situations (not just inside your own home)

    and erm yes we could prob phone the phone in court and prove it lol i cannot remember a time i got threw to her phone the first time i called it! and the chap at phones4you has seen it aswell, we just working on a letter to send them...

    On 5/01/10 I purchased a TG01 mobile phone, received it on 5/1/10. I have discovered that the item had a fault, I then replaced the phone on the 19/01/10 however the replacement phone has a fault with the speaker, I then went back to the Orange shop and asked for a new replacement phone, however, was only offered a refurnished phone which I rejected, therefore I asked for a full refund quoting the sales of good act, nevertheless, this too was rejected.

    The Sale of Goods Act 1979 makes it an implied term of the contract that goods be as described of satisfactory quality and fit for purpose. As you are in breach of contract I am rejecting the TG01 and request that you refund the sum paid to you of £149.00, plus an administrative fee of £25 and personal compensation of £30.
    I also require you to confirm whether you will arrange for the TG01 to be collected or will reimburse me for the cost of returning it.
    I look forward to hearing from you in the next seven days.

    Thats the problem I've always found with Orange, they've had your money, but when you have a problem they aren't all that keen on helping you out.

    ok, but she has had the contract for a good 8 months now, the other mobile she has recently got is only a few weeks old, would she have to send this back? or would she keep that and them (orange) refund her in some way? im still pretty unsure where she stands and so on

    I can echo this too. I'll never go with Orange again. Really bad attitude towards even the smallest of issues.

    cant help much with the contract part, but i had a similar problem with my phone on o2 a while back. texts not arriving and all coming through at once at random times, only every 10th phone call goes through etc.

    turned out that the 3g network was screwed in my area. try going into the network settings on the phone, and try to find a setting to change the default network selection to GSM, instead of 'automatic' or 3g. hard to give exact instructions without knowing the phone model.

    if your mum has the same problem i and others in my area had, then that should fix it. if not, its worth a try anyway.

    me neither, I was with Orange for just under 4 years, two contracts at a monthly average total of £80. The hassle I had with them whenthey removed an unlimited text bundle and then proceeded to charge me £300 for the privilege. I won't even begin to describe their 'retentions' team, aside from the fact that they're very good at professional BS.

    Mate is with Orange and has loads of hassle. Is Asda good to go with or Virgin?
