    bank holidays....and searchs at work?

    does anyone have any idea how things work when it comes to bank holidays? ive got a lan setup for this months (31st) ive spoke to work but they want me to work it and say that i have to if im needed, thing is i work nearly every bank holiday, last year i had 1 bank holiday in the working week off. there pretty darn unfair and it really anoys me so i though i would ask!

    also.....can they force me to be serached when i leave the building? i dont have a bag so im made to empty my pockets before leaving...none of this was in play before i started my job, the stupid LP decided it was a good idea to bring searchs in, but its buggin me as ive waited 20mins to be searchd so i could leave!! i just want to know where i stand here

    Banks holidays would be in your contract.

    Eg mine says 'Due to the operational need's of the business, you may be required to work on a bank holiday/public holiday'

    I'm not to sure about the searches though.

    Depends on what your contract says.

    I'd say that if you're working full time anyway and your colleagues are all getting a paid day off then you would have an argument for getting some compensation, a day in lieu or a compensatory overtime rate.

    When I worked on a shop floor they insisted that we worked bank holidays and those that didn't had it treated like any other day when they weren't working, though those that did work got time and a half for doing it.

    Bank holidays aren't mandatory in the UK AFAIK, though there is a minimum number of days holiday you have to be given, they don't have to be bank holidays.

    Whatever it says in your contract. I don't know of any statutory rights that would have precedence.

    Being searched is probably in your contract that you consent to it, that is one of the things that if you do like it you need a different job. As to bank holidays, if you have to work a bank holiday you should be able to take a different day insted. You get 28 statuary leave days a year, it is allowed for a company to mandate any of when these days are taken in the year, however normally most firms close on bank holidays so workers are forced to take those and leave the employee to pick when the other 20 are taked. Leave is accured within a year so if you start working December 1st and you company end of year is january 1st, you get 2.3 days and you will be "forced" to take 25th & 26th, so can pick no leave that month!

    I believe Bank Holidays are included in your mandatory minimum holiday allowance and it's up to individual companies whether or not they make you take the actual bank holiday or whether they provide a day in lieu.

    With regards to the searches, I believe these should be contractually obligated, something that if they were bought in after you joined, would require your contract to be ammended and counter signed. Anything else is a breach of human right to a private life AFAIK.

    well, they came in about 2 years after i started. ive signed something to say i agree to it but only because i was told "if you dont sign it then we will have a problem" and these were exact words from my managers mouth.....

    That's where I would asked for compensation for them changing my terms and conditions. If they had "had a problem", and got rid of you it could have been constructive dismissal.

    Bank holidays are no longer statutory holidays, as part of this change the minimum legal holiday allowance was changed to 28 days holiday a year - pro rata if you don't work five days a week.

    i work 5 days a week, only on a 20 hour contract but i do alot of overtime on a regular basis so will work anywhere between 20-35 hours i think* i get 26 days holiday a year due to this, bank holidays are not included in this holiday, they are extras, from what i can gather anway! i do have a handbook which has all the information, i also have my orginal contract so technicaly i dont have to be searched untill its in my new contract right? today i was 15 mins late leaving work, its pretty embarassing having to empty your pockets out...and abit nerve racking when there is alot of customers around you! you never know who might swipe something and run.....the bank holidays are not teh main problem here, im fine working them i get double pay for it lol the last one got me 48 quid for one day! get in but its just when i request 1 off...

    I know a lot of companies will have a policy that staff searches are done in private, might be worth checking to see if your company has such a policy, then raise it with your line manager if it is not being completed in line with said policy.

    I am confused if you get

    a) 26 days + bank holidays or
    b) 26 days including bank holidays.

    a) is more than the minimum
    b) is less

    Oolon - may be adjusted due to the number of days worked this (and logically last) financial year - so the more hours he does over his contract, the more days holiday entitlement he'll receive.

    Staff searches is a very dodgy area.

    Any attempt to search a member of staff without their express permission opens up a whole can of worms, not least of which will be the possibility of assault charges (physical or sexual) against whoever does it. However, you contract of employment may well cover searches, and if it does, it is likely to constitute express permission, unless and until you expressly withdraw permission, which you are entitled to do.

    However, if you do withdraw permission, it may well be part of your contract that that will trigger disciplinary action, and possibly even dismissal. A lot is likely to depend on circumstances, and it will certainly depend on how sensitively the search is done, by whom and whether it is done in private or not. After all, a quick frisk is a different proposition from being stripped searched by a soldier while a couple more stand and watch, holding machine pistols at the ready .... and I was on the receiving end of one of those latter ones some years ago.

    holidays have always been a funny one at work, they have a clever way of getting you to not work a monday and put you in on a sat 6 weeks before the bank holiday, this way they can make you work bank holiday without paying you double pay lol, theres alot of dodge that gos on at my work, after all its an american company and english law isnt always applied...theres lying from managers to staff aswell, tbh its VERY crap to work there and because of this there is a change of staff EVERY year, ive only stayed so long as i need the money to support my kids, so jeopardizing my job is somthing i dont want to do but the searchs are getting abit out of hand, waiting around is a problem unless im being payed for it lol

    but anyhow, it does not state ANYWHERE in my contract that i have to be searched upon leaving the building, but im unsure about this "sheet of paper" i signed a few weeks ago and how that runs with my contract?

    what about "expressly withdraw permission" what do you mean here?
