    can work really demand this?!?!

    Guys, quick one, work are trying to get me to signed a new contract to say this....im not aloud to buy anything from the store and sell it on....

    now im pretty sure once i buy a product, be it a shirt/trousers or ornamental product, im aloud to sell it on if i choose to right??

    ive not signed it yet and really dont like the idea of it! its out of order right? how can they even demand that? they dont even make the products! so...

    guys what ya think?

    Do you get any kind of staff discount? Does the shop stock rare / hard to find items or some kind of specialist equipment, or any substance that is controlled in any way?

    I'd guess that they can put any clauses in their contracts that they want, but I suspect that they can't force you to sign a new contract (unless your existing contract stipulates that they can). On the other hand, they can also probably make you redundant with appropriate notice and very little recompense, and you need to consider whether this clause is worth losing your job over.

    I'd also like to point out that the fact that you're making a fuss about it suggests that you would consider / are considering doing this, or have previously done it. Which means they might have a point

    well, yes i bought some stuff from them its a normal retail shop? but after time you sell them dont you? well some people do, like old games and such, no the store doesnt hold any rare stock but we do get discount, it doesnt state anything about it in my old contract, im unsure if it states that they can change it?

    Not unusual for these kinds of clauses in retail companies.

    As for getting you to sign, that depends on your existing contract, it may have a clause that says they can change it (maybe with notice) or they may just effectively terminate your employment and re-employ you with a new contract. There are ways they can do this, I know when they brought in random drug testing here they basically asked everyone in the company if they minded the contract ammendment, if a single person did they were going to terminate everyone and re-employ - but nobody did.

    Its more giving them the right thou isn't it?

    If your controlling stock in a warehouse at TK Maxx, they might be worried that staff will cherrypick the best bargains they put forward. Often they will choose to make little profit, sometimes even a loss on certain things to bring people in to the store, as such selling them on could net the staff a profit, who would be in a great position to bogart the best deals for yourself.

    If you sell something on that you've held for 3+ years, then its a bit different. I'm surprised they've not simply imposed a time period, no resell within 18 months say.

    Make an alternative suggestion to them? Suggest that you will not sell on/get rid of goods for at least 3 months and you will never ask for more than you have paid them (as its only for second hand disposals). This means you cannot sell on for profit however you can still sell second hand.

    Then I'd guess they have evidence that staff are buying items discounted and then selling them on somewhere between the staff discount price and the full store price, making a profit for themselves and denying profit to the company. Doesn't seem unreasonable to try to stop that, tbh.

    its a 10percent discount i dnt always get its so useless lol, i think its disgustin and out of order personally, i dont go out of my way to buy stuff just to sell on but to try and stop me from buying it to sell it is unbelivable! thats like saying i cannot go into anyshop with the intention of buying to resell.....

    It's hardly disgusting, it's basically saying that some people are abusing their staff discount, and we'd like to try and stop it before we're forced to take the discount away.

    I'd personally just sign it and then wonder how on earth they plan to enforce it

    I agree with Lucio on that one, but I also believe that 99% of the time, the people who complain the loudest about things like this usually have something to hide / lose from it

    If you are innocent you never have anything to worry about when things like this happen in my opinion

    I think ideally it should be changed to "buy anything from the store and sell it on for profit", which would be reasonable. TBH, if you sold an item some time later after buying it, I doubt they would either know or care, especially if it's for less than you bought it for.

    If you are purchasing with a staff discount and then selling on for a higher value for personal profit, then I would say so, yes as it would be considered as you working in competition with your workplace.

    If you buy something, use it and the sell on ( not for profit ) I can't see why there would be an issue with this.

    Other retail stores get around the issue of staff reselling for profit by setting a limit on the amount that can be bought using the staff discount. This also stops people from joining to use their staff discount on a big spend and then leave the company.

    You weren't allowed to receive cash in return for your staff purchases when I worked on the high-street, but everybody ignored the rule - managers included.
