    internet domain names

    anyone know about internet domain names and the legal stuff, if a company has the same domian address but not the same prefex as .co has just been released/

    if i buy a domain name thats the same as a company what are the legal aspects that could arise?

    It rather depends on who you're planning to domain squat... essentially if you're buying it to try to sell on to said company expect to have the domain handed over to them. If you're looking to actually develop the website I'd be asking why you really want to use the same domain name...

    It depends, any reason you must use a non-specified existing domain with a different TLD? I'm guessing that's what you mean. I wonder how long until someone brings up mike rowe?

    Just theres a mod i used to play that has the same name as a bank, i wanted to up load files and pictures, keep the memory going.

    IMO Providing you're not pretending to be the company in question or be in competition with them there is no real problem, but be prepared that if the company wants it you may have to give them it.

    If the name is a trademark / registered trademark of the other company then you could be risking an infringement of that. If it's a big company and they actively protect trademarks the chances are that they'll already have pre-ordered the domain anyway, tbh. I don't think there's really any way of knowing how the company will react without putting it to the test though....

    Trademark will be the concern. If they have one for the region you are in then forget it.

    i checked and they have none, did a valuation on the sites names came up with a few hundred pounds, not bad for one day, now to get started and build my sites.

    Basically the biggest risk is having to take time to attend a tribunal if your right to the name is disputed. I don't believe there's been cases bought against people unless they've been involved in some other trademark infringement.

    E.g. if you buy say pepsi.co and started marketting a cola based drink from it, then you'd likely end up in court. If you bought pepsi.co and then launched a fan site from it, then the worst that'll happen is the domain gets taken off you.
