    gross misconduct

    i'm just getting ready for my hearing on g misconduct for post on facebook, after not even mentioning the company, staff names or customer names, i'm still in for the hearing, any advice for me in general please?

    I'm guessing you did a search on gross misconduct and found this site. I know there have been a few threads on the subject, but that isn't really what the site is about.

    And anyway, you shouldn't be posting threads like this in the Welcome forum, it's more of a General Discussion thing

    can you post exactly what you posted on facebook (just star out any names)? also, did you post from your own pc in your own time, or work pc either in your own time (ie break or before/after work) or during working time, even during working time from your iphone? also, is your facebook account under your name ie. "joe bloogs" or under a nickname like "shoes349"? also, do you have many collegues, or any bosses or your companies customers or suppliers (or staff who work for them) as facebook friends to see what you posted and they know it's you? did you post something negative about the company, either true or false, that may bring the company into disrepute? have you posted a lot of stuff during working hours?

    for gross misconduct, an offence has to be serious enough for the employer to cease working immediately, thus normally the employee would be suspended on full pay, given notice of a formal disciplinary hearing and time to prepare a case

    some examples of gross misconduct would be theft, violence, doing something to endanger lives. abuse of internet policy would normally be misconduct

    thus for gross misconduct you would normally expect a situation where you brought the company into disrepute by saying x product is crap, x boss is crap, or causing the company some other problem like saying x product won't be in stock for ages or another person is cheaper/better, thus having a detrimental effect on the business

    if you've basically been caught wasting loads of time on facebook, then that wouldnt normally be misconduct. if it's serious enough it may be a final written warning (ie. if you spend 3 hours a day farting about online), but that's not enough to warrant gross misconduct

    if you can answer the above questions and give an idea what you said and if it's in your own time, if you can be easily identified by the username and who may have seen it, it will help. even if you said something bad, if not many people can see it, it might not be worthy of gross misconduct, but that's why the company should have suspended you pending an investigation, they may decide after the hearing that it's just misconduct

    Yeah you shouldn't of done it. Have some common sense. Anything you post online is open to being seen by people and is on there forever. There are a lot of stories of people doing similar things and being sacked for it. Depending on what you put you could end up the same.

    Speak to a solicitor would be my advice, most peeps here can OC your computer for you but for something like this i would speak to a professional.

    so you called your boss a C word on facebook?

    and who do you have as facebook friends that would have seen this? how many people you work with?

    would someone have to had grassed you up, or would another manager been able to read it?

    is your page private for friends only or can anyone read it, thus a "friend" of a "friend" who saw your real name would read your page for a nose?

    did you post this whilst at work or in your own time? it's obviously from a mobile device

    i have not called my boss the c word, it was a dig at the blythering idiot dave cameron, for not knowing the history of the 2nd world war, 3 people out of 36 friends work at the same depot i do, after deducing a colleague used his facepest to access my account and screen print/ email to head office mt status updates, alot of the comments were not directed at any particular group of people i.e. horoscopes in the press.

    alot of updates and posts were from a mobile device, but due to the nature of my employ i'm able to facilitate legally
