    So...UKNova is dead

    After threats from FACT.

    An interesting case this one, certainly ethically...

    No ads
    Not for profit
    No staff paid
    No listings for anything available for purchase
    FACT demanding takedowns of content they have no authority over whatsoever.

    I never used the site, indeed hadn't heard of it but from what I've read it is a real shame.

    An ethical digital catchup site? Can't have that, can't allow people content they cannot get any other way because their VCR crapped up/out of the country, serving the country.

    I find it interesting the FACT refuse to comment, typically they're happy to shout from the rooftops about a major thing like this. PR blunder?

    This kind of thing really makes me mad: "Oh pirate this, pirate that, oh we're losing money"...yeah, on content you aired for free and wont sell.


    Edit: And yes, illegal is illegal, but no-one gives a toss about ripping a CD to itunes. No-one is going after big companies for 'infringment/facilitation thereof' on a massive scale. I see this offering as no different to ripping a CD to MP3/catchup TV site, personally.

    Copyright infringement is still copyright infringement whether the items in question are available for sale or not.

    TV stations are licensed by the studios to broadcast their copyrighted material.

    Since you cannot legally distribute copyrighted TV shows by any means without written permission, unless UKNova had written permission from every studio that filmed every show they were indexing, or could prove that all people sharing them did, then they were assisting in the illegal distribution of copyrighted material.

    Whether you or I agree with it or not is beside the point that is the law.

    That's because you are, or should be, ripping a CD you own into itunes so you can listen to it on your Ipod. You are not distributing it.

    If you rip that same CD into a friends itunes so he can have it on his Ipod you are then breaking the law because you are now distributing it.

    Rip that same CD to a website and make it available for download and you are breaking the law.

    You see the problem here is people were left alone to violate copyright for so many years with VCR's and tape decks that now companies are deciding to enforce their rights people think they are being slighted.

    It's still illegal. So then, I trust you've never done it and have reported anyone you know who has done it to the authorities? Or do you also pick and chose which laws you follow, like everyone else on earth.


    Interesting to fall out the black and white legal side of it rather than debate the singular failure of the industry to offer these services AND that the industry/rightsholders themselves have not issued a single complaint.

    I'm going to take my usual tack here, and ask what the point is of closing the site when there's still no viable alternative.

    I'll applaud Channel 4 on 4OD, especially their decision to include very old shows that you just can't see on TV any more, but every company needs to start doing that, and making the files available for download. Whether they charge or not, or how much they charge is totally up to them, but there's a big difference between closing a site like this and saying "you should have got your content from this website legally", and saying "great, no more piracy", when all of its users have absolutely no way of obtaining that content by any method other than piracy.

    That's not to condone it, but simply to ask why they're not focussing on making money as a priority rather than suing people. The music industry has caught up finally, although they could still make a lot of improvements (FLAC anybody?)... the TV and film industry by comparison acts like it's still the 90s.
