    sky broadband cancellation

    hello all

last april i cancelled sky broadband when i split with my ex partner that was ok they give me the mac code that was passed on to the ex's son who then migrated to a new isp BE broadband only getting myself sorted about 3 months ago i never checked any bank statments i noticed 2 months ago when i noticed a sky direct debit i requested bank statments for the last 2 years they are still charging me £18.50 a month for broadband from april 2011 that skys broadband was not in use in that house and a further £8 a month for sky protect too! i notified sky about this they say they said that they never gave me the mac code which is lies, surely they have a duty whenever a mac code is obtained the broadband would more n less be cancelled?? they owe me in total over £500 is there any way i could get this refunded?

    Any advice will be appreciated.

    Re: sky broadband cancellation

AFAIK, getting a MAC code doesn't do anything inherently.

It's only when you hand the MAC code over to a new supplier and they begin the transfer process that there's any kind of result.

    Re: sky broadband cancellation

You need to read the Terms and Conditions of the Sky contract, particularly the bit about giving notice. As snootyjim says, just requesting a MAC code may not trigger a notice period until it used.

    I would seek legal advice.

If you were given the MAC code which you then passed on to your EX's son then surely he can stand as witness to the fact that a MAC was obtained and used to get broadband from another supplier.

Most isps state in the terms and conditions that even using the mac code is not cancelling your contract. I know for sure that if you had been moving in the opposite direction then Be insist you cancel in writing after using the mac code and warn you that your contract will continue otherwise. I wouldn't be surprised if sky is the same.

    Re: sky broadband cancellation

Back to basics here, when did you take on the Sky contract and at any time did you make alterations to it ?

Bet you didn't have the right to cancel it and they are well withion their rights as per t&c's to continue billing you for early cancellation.

    Re: sky broadband cancellation

Thanks for the reply guys I had sky broadband for about 5 years it was more n less a rolling contract there was no changes to the broadband only the tv package when I cancelled that 2 months before I gave the son a couple of months to sort himself with a new isp, but could BE broadband be able to supply me with proof that I used the mac code in april of last year surely they would know when the last time that I was using their broadband? If I owed them a tenner they would jump through hoops to get it! Lol

I emailed the girl about it and she is looking for be broadband to show when the change with that mac code happened

    Thanks guys micky

You say you gave him a couple of months to sort out a provider? mac codes only last 30 days if that.

    Re: sky broadband cancellation

If you made a change to the TV package it could be argued you've changed your contract with Sky and so therefore a new minimum term has been agreeed. You really do need to go back to your original t&c's of your original contract from Sky 5 ears ago to see what that says.

    Re: sky broadband cancellation

    Dear Gemma,

BE Internet has been contacted and have provided the following response:

    Ticket ref. number: ********

We are sorry to hear about the issues you have been having! We would like to
confirm that we took over your line on 18/04/2011 using MAC code
**************. We would not have been able to push our order through the
BT/Openreach systems, if we did not have a valid MAC code. Furthermore, as
soon as a migration is completed, the Openreach system sends a cease
notification to the losing internet service provider. Therefore we have
reasons to believe that they have definitely been notified that we have used
the MAC code. Should you have any further questions or requests, please do
not hesitate to contact us at any time. Kind regards, Petar BE Provisioning

If you fancy chatting to us call us on 0808 101 3430.

(if you would like me to forward the email to you with BE Broadbands address
etc then please provide me with a forward email address)

Gemma as you can see, the date I left Sky was on the 18/4/11. It would not
have been possible for me to migrate to BE had Sky not provided the above
    MAC code (*************.

Due to a mistake on Sky's part you continued to charge me for a service I
was no longer receiving and because of this I want a full refund of the
money owed or I am going to have to seek legal advice as I will have
exhausted any means of solving this amicably through Sky's customer service.

Thank you for your help and understanding. I look forward to your response.

would that guys be enough proof that i did not use sky broadband after that date?

    Micky
