    Well you have a strong argument here mate, the description does not state the damage therefore this isn't really a case of 'i don't like it so i want to return' its a case of the seller not providing sufficient information for you to be able to make an informed purchase in the first place. I would keep pressing this point in the case and just see how far you can get.

    Irregardless of it being in America and the postage being expensive, if it was in the UK i would expect the seller to cover the return costs in the event of 'item not as described' or provide a full refund once evidence the item has been destroyed if they don't want it back.

    Exactly ,and the fact Im in the UK means it was either damaged beforehand by the seller or by post ( and there was no damage on the box ) given how it was sealed to suggest it was UPS.

    The item itself was inside molded plastic.

    There is no way then that item could of been damaged by post unless it had been taken out of the box, as it would of been obvious from the damage , and more than likely ( given how well its packed ) required enough force to destroy the box or rip it.

    The problem is .... what if the seller claims it was fine when packed, and therefore must have been damaged by the buyer (you) when they opened it. Not saying you did, but that they can claim that.

    In which case, it'll come down to eBay's resolution process, and what they require of each party. Do eBay require buyers to return goods reject on a SNAD basis? I thought they did, but then, I don't use eBay much.

    Also, of course, don't forget many international parcels are opened, inspected and resealed by Customs, or their agents, on importation. It's another place damage could have occurred.

    True , but the box was sealed when I got it and undamaged, wouldnt UPS or Fedex know if they did ?

    It would make no sense for me to damage it intentionally as I got it a good price , also I reported this on the day I received it , so I barely had it that long compared to the seller whose had it for at least 3 years.

    What I did in a situation like this where sending back a faulty item would have cost me more than I paid for it was to explain to ebay the postage issue and tell them that I would happily destroy the item and provide them photographic and/or video evidence of me doing so.

    They were more than happy to issue a refund on those grounds

    Some courier firms are the agents for Customs I mentioned. They do inspections under contract. Would a re-seal always be obvious or visible? Dunno.

    Well, I didn't say you damaged it intentionally, or even that the seller would allege that. You could, however, have opened it, fumbled, dropped it and damaged it.

    Again, I stress, I'm not suggesting you did. Merely that the seller may genuinely believe you did.

    It could, for example, have been a hairline fracture that the seller was not aware of. Suppose you had been the seller ..... as far as you know, it went into the box in "perfect" condition .... or apparently so. But in transit, it gets boinged around a bit. Now, you pack it well but that boinging puts a bit of stress on the head, and .... crack. When your buyer takes it out, it's broken.

    It might have happened that way, is all I'm saying.

    Whether you'll get your money back or not, I've no idea. I hope you do. I'm just pointing out that it might not be any deliberate attempt to deceive on the part the seller. You seem with good reason, to think he/she is trying on it, but they might think the same about you. if something like the above scenario happened.

    And if it did, it's part of the risk of buying via eBay, sight-unseen, especially internationally. eBay is not without it's risks, most notably because if something goes wrong, you're almost entirely dependent on eBay's decision for a remedy, and pretty much powerless to do anything about it if you don't like it.

    Myus does have an option to check parcels, but it costs to do it..

    I was in 2 minds to do it for this too , thats whats even more annoying about it.

    Well ebay are not being helpful at all.

    I asked about their return policy and that I had similar case resolved last year without having to return the item - they said they've " updated " their policy .

    Now their avoiding answering what exactly they mean by original shipping if I send it back for a refund .

    Im assuming they mean what the seller charged me ( not all shipping costs ) but when I asked them, they just repeated the same thing...

    Buyer protection says a full refund includes original shipping and buyer pays for return shipping , so Im assuming my idea of what they mean by " original shipping " is correct ?

    myus and their international business is going to suffer badly if they think people are going to allow this , their new policy will just encourage bad sellers to even be worse.

    I got so angry about this whole incident i mailed the seller and told him to enjoy the feedback I gave him for scamming me.( there is no report of damage from myus or UPS )

    Then I got this abuse lol

    Next time you should tell people that your overseas. Not in Florida!!!!! That was a very delicate piece!!!! You wanna call people names? Up yers ya STUPID PALMY!!!! I could have packaged much better for overseas travel. When everything is said and done, we know who the real scammer is!!!!! Beat it ya stupid RED COAT!!!!
