Network Operators: Must they provide an unlock code?

Posting here because we don't have a better consumer advice area

So, long story short, EE have been dragging their feet over providing an unlock code, it's been over two months now, they said it would be sent via post. They've changed their mind saying it was sent via email, only problem is, they don't have an email address for me.

They are now claiming it will be another month, after I have begrudgingly given them an email address.

Basically this means I've got to buy another smartphone as I need a localised data smartphone for work purposes. So I'm a bit pissed off.

So I figure, aren't there some rules about providing them? Have they broken contract?

Hmmm interesting one, afaik they don't have to (not based on anything other than a feeling) but if they've agreed to do it then take ages surely that's likely seperate issue and it seems like they didn't do it properly the first time (hence needing another month)
I got mine off ebay from a reputable seller, £17-odd and it was emailed to me within 2 days IIRC, not a great answer but depends how desperate you are.

Re: Network Operators: Must they provide an unlock code?

There are strict rules regarding number portability, but no rules exist for handset unlock codes

Re: Network Operators: Must they provide an unlock code?

I believe they have to but only if the device has any subsidy paid up, so a minimum time on pay-as-you-go or the contract is up.

They don't have to make it easy or cheap though. Three wanted to charge me £15 to unlock my old HTC Hero, but by then the phone frankly wasn't worth that.

Re: Network Operators: Must they provide an unlock code?

IIRC, there are rules about providing MAC codes, and in a timely manner, and while that's clearly not the same thing, it does suggest it's possible. But, I'd also suspect EE unlocking is perhaps a bit recent for rules like that to have been brought in.

    In short, dunno.

But .... ring OFCOM and ask? If there are rules, I presume the rules would be theirs? And if there aren't rules, maybe there should be, so again, call OFCOM. Get the ball rolling, or help give it a shove.

Re: Network Operators: Must they provide an unlock code?

Orange wanted a £20 "admin fee" to unlock my phone that's out of contract, I went elsewhere and did it online for £5.

Re: Network Operators: Must they provide an unlock code?

New law changes recently make it so Network Operators should give unlock code For Nokia lumia phones or iphones or any cell phone that is locked to their network if you meet their requirements. If they do not provide unlock code ask to speak with supervisor and threaten to report them to FCA. If you want to skip the hassle of getting a factory unlock code from Network carrier go to a third party unlock service.

    Booker, welcome to HEXUS.

The Financial Conduct Authority is not responsible for mobile telephony operators. However, as this post is over two years old, so I hope the OP has received his MAC code. Danceswithunix posted a useful link in post number 7 if you are having similar issues.

Just in case anyone has un-answered curiosity, it only took them a further 3 months, and I was given the code! Woooo.
