    Parking Space Issue

    Before I start I understand that any advice given is personal advise, and is not professional advice.

    Bought my house around either months ago which came with three parking spaces, and all was ok until some tenants moved into a rental property few doors away. I have two parking space that are directly in front of my house, and I a third parking space three house away. On a few occasions I have had friends over or workmen, and have had trouble with parking availability. I have looked at the title deeds to my property to see exactly what it said, and it has my 3 spaces and house all marked in red all with 'C' on them. On the title deed 'C' stands for casual parking space, and above that there is also 'S' for parking space. Can anyone shed some light on the meaning of causal parking space in the context of house deeds?



    Also on a side note I have noticed that my house has a different number on it to what is on the front of the house, apparently my house should be further round a corner from me. Is there a way to check why the house numbers are different to what is on the title deeds?

    What's on the deed may be the plot number, which would be different from the street number as they probably decide on these after the buildings have gone up.

    As for the spaces, it seems to imply that they are set for visitors, although for the 2 directly outside your house, this seems a bit strange. Is there any wordy bit that might further explain the graphics?

    I would have thought that casual means just that. They are not allocated (or owned) by a particular property, they are for casual use by anyone.

    Not sure I fully understand. Any chance of a diagram?

    The parking spaces are in the road? Is it a private road or public road? If the spaces are on a public road I do not see how they can be yours unless it is tied up with parking permits.

    One thing to remember is that it doesn't matter what it says on the deeds. If someone has access and uses a space for a number of years without complaint, they gain the right to do so.

    The people who are renting have only just moved in, and I have been using the space since I move in 8 months ago.

    The first red boundary is my house and two parking spaces, and the second red box is the third parking space.

    From the diagram it looks as though 'S' parking spaces are allocated to a particular property, while 'C' parking spaces are first-come-first served spaces for anyone.

    I agree that is a bit confusing. Going by the parking space numbering, you are only allocated one parking space, the one three doors down.

    However, the red line normally denotes your plot of land and the deeds would appear to suggest that the two Casual Parking spaces are on your land and would effectively be like a driveway. But, it may also just mean a right of way access as your allocated parking space and it's land would "block" the other spaces in that area. It might be worth getting a solicitor to look into your deeds properly.

    If does prove that you own those two spaces, then I believe you would have slighly more trouble maintaining those spots clear. I have heard lots of rumours and so on about private parking firms and various laws when they ticket cars on private land.

    Or you could just show the new tenants your deed and explain the situation. The chances are they would accept it as it is.

    I will make an appointment to see my solicitor as you say they could shed more light on it, and I would have a clear idea of where I stand. If the two spaces in front of my property are deemed to be within my boundaries, then I would if possible want to sell that third spot to the landlord of the rented house.

    Again, your solicitor will be much better at advising you in this, but you may find it is written into the deed that you cannot sell the allocated parking space seperately from the main house.

    There is nothing to stop you owning the land but other houses have the right to park in those spaces.

    Who knows how it works.... ask a solicitor.

    This is how I'd read that deed, certainly. The two casual spaces that appear to fall within your boundary are not allocated to you, while the one round the corner clearly is. If I was you I'd have a read through the deeds to find out what the blue shaded areas mean - they appears to be spaces to which you have shared access AFAICT?

    I think the only thing that isn't debatable in that is that the space three doors down is your allocated parking space. What you can do about someone else using it is another question....
