    Been shafted on ebay is there anything I can do?

    I bought a monitor off ebay that was DOA but the guy refuses to do anything about it he just says it worked when he sent it, apart from going through the ebay claim process is there anything else I could do?

    Is there any kind of legal proceedings I could follow? I don't want this guy to get away with this I am livid!

    well if anyone lives in the Devon area...... jk I would like to see him brought to some kind of justice but that's probably never going to happen in this country.

    I presume it was insured when he sent it, otherwise hes liable unless he clearly stated no insurance, no liabilty. At the end of the day its the senders word that it worked before it was sent.

    Did you pay with PayPal? If so advise him you will reverse charge the transaction unless he helps you come to an amicable solution.

    If you paid with your CC, dispute it with them and you get the money straight back.

    Anyone who sends a monitor without insurance needs to be seriously avoided imo

    I paid by cheque unfortunatly he wouldn't accept any other payment method, he is now emailing me and saying he thinks I have made up the damage as I no longer want the item, wtf is this guy on!

    He also says it is too late to claim against the couriers as it is outside 24 hours.

    Inform the police if necessary, and then fill the forums in for small claims; see how long he messes you about then.

    I wasn't sure if I could use the small claims court, I shall go down that route if he doesn't become a bit more helpful.

    thanks visidigi I've copied and pasted that part of the T&C's into the email I sent him, if he is lying about that he could well be lying about the monitor working before he shipped it.

    not a problem mate, I work for a international courier firm, I deal with all the ebay scams, and theres lots unfortunately, especially hard to do when all the customer does is call up to ask where the package hes sent has got to because hes waiting to be paid, its hard telling him hes lost it.

    Ive had some success tho, stopped a guy losing a 7 grand watch....and his wife

    I hope he was greatful for that, there again some men would be glad to get rid of the old ball and chain
