I think i have quite a good story/excuse now:

I will walk into the shop and politely ask for a full refund on the phone.

They will either say why? or no!

I will say that I have been mis-sold the phone. I need a reliable phone which is going to be used for emergencies but mainly used for texting. This phone is not ideal for either.

Only 10 messages can be stored on the phone also the predictive text's vocabulary is very poor. This was a feature i specifically requested. The phone does also not vibrate when receving a text so therefore i am unaware that i have one when the phone is in silent mode.

Secondly, the phone suffers from a signal fault. I am positive that it is not a problem with o2 as my brother has a 3310 with o2 and in the same place he receives a signal where as i dont. The signal will return if i leave the phone off for several hours with the battery detatched. The battery life is also very poor with it lasting a maximum of 2 days. This unreliability and poor battery life makes it un-ideal to be used for emergencies.

I know my rights and the Sale of Goods Act 1979 states that any goods must be fir for the purpose they were sold and as described. In this instance the product is not ideal for its purpose and not as described.

Id say wait a couple of months before grabbing one. There is a version of it coming out (P900) which is even better specced .. so by then.. you could choose to get a P800 or a P900.

If you want to chance your arm, you could always ebay for one now, as they fetch about £250 on there
