    My Boss is a (insert expletive here)

    Well I will soon be leaving permanently as my wife and I are off to Canada but I foolishly assumed I was still entitled to certain normal working conditions like holiday. I put in a request today for holiday from the 23/07/05 - 02/08/05 and my boss said that he would not let me have any holiday as I was leaving soon anyway and I was lucky he had not already got rid of me because I am emmigrating. Now forgive me for being a little cynical but if I am entitled to 21 days holiday a year and I have only had 7 days up to now and the holiday starts on the 1st Janauary each year, I must still be owed some. He wanted me to let him know a date for my departure from the company and I guessed at 1/09/05 all dependent on the sale of our house, he seems to have taken this as my verbal notice and does not think that he requires a written notice and is expecting me to leave whether my house is sold or not. The guy is a $*^%

    As your still employed by the company and you haven't handed in your notice you are entitled to take holiday as long as you've followed whats in your contract.
    Even if you have handed in your notice they would normally agree how many days holiday you have left and ask you what you want to do. I know my company run this way.

    Tell him your entitled to holiday

    If he tells you he wont give it you because your emigrating, chances are you can stitch him up, as your entitled to them as youve only used 7 days and have 14 left, he just doesnt want to give them you as your leaving soon and doesnt want to pay you an extra 2 weeks work if you take holiday 2 weeks before you leave as he will have to pay 2 weeks wages for nothing.

    That's against employment law. If your contract states that then you're legally entitled to do it. Gently remind him that he does and make it clear that you're stubbornly prepared to take it further if your rigths are denied.

    Or assuming your notice is two weeks then just hand your notice in and then walk out, (read your contract first) as most contracts will state that holiday can be used in lieu of notice.

    Well my notice period is 4 weeks so I can hand it in and then not come in for the last 2 weeks but he will have to pay me. I do not think he understands his own employee contracts.

    I would go to HR and deal with them, afterall its them that deal with your pay

    Then take it to the authorities. Get your contract and take it to your local Citizens Advise Bureau and see what they have to say about it. To refuse you holiday on the premise that you are emigrating is, as far as I am aware, illegal and especially since you haven't yet handed in your notice.

    the way it works here you get 20 days for the working year from 1st of January, BUT it's worked out that you earn 1.66 working days per working month or something sooooo.. if you work up to your 2 weeks notice or something, work out how many days you get from 1/1/05 till then and show him that. It's probably in your contract, more likely than the "You can't have holiday if you're emigrating" clause. If that doesn't work - employment tribunal. Get your holiday AND a compensation fee...

    Surely, as most companies are, your holiday would be worked out on a pro rata basis with HR, so "IF" you were to leave on the 01/09/05 you should be entitled to the holiday you would have earned during that period. so you will have worked 273 days of the 365 day holiday year which by my calculations means take 21days divide by 365 and multiply by 273, which gives you holiday entitlement of 15.7 days over the course of the year "IF" you leave on 01/09/05. But obviously if you leave later you'd be entitled to more.

    As you say you've already taken 7, then they at least owe you 8.7 days worth of holiday


    Running the calculations through again upto todays date you've already worked 168days of the year, so 21 divide by 365 multiply by 168 = 9.7 days

    So you've already worked enough for an extra 2.7 days holiday.


    Check your contract about holiday and see what it says is the best bet.
