    Suing Natwest, final stages now.

    Has anybody done this on this forum? Sued their bank for the charges they've been given? It's a VERY long process, but tomorrow I actually put in my claim, (they then have 14 days to respond or I win, if they respond it's 14 days before court or they settle)

    You can sue and reclaim ANY bank charges in the last 6 years. The charges by law are meant to cover the admin fee involved in informing you only:

    £35. An automated, auto franked, generic letter? (which they only send you occasionally) £35? Pull the other one.

    I'm thinking of doing the same with my bank who I shall not shame yet as they always apply the charges 3 DAYS before I get paid and then levy another fee on top of this as well for going overdrawn.

    whats 72 hours to a bank ?

    60 quid a month at the moment

    Don't even consider waiting, just DO IT. It costs nothing (until the final stages now) and hundreds have won (not heard of a single loss yet) huge, supportive community at Consumer action group. It's a win win. With my winnings (touch wood) I'll pay off my overdraft and get the funk out of Natwest!

    This is a good idea in the majority of cases but the only drawback to it is that some banks will argue that you obviously don't agree to their T&C's and therefore close your account. Whilst this may not trouble you, anyone who is currently overdrawn needs to lookout as all they owe will be demanded back upon closure, and after being the one who initiated it they won't be too lenient if you can't pay it back.

    6 YEARS... BLOODY HELL...

    Checks statements, and calculates charges levied.

    hmm I'll get rid of my overdraft was well and this would allow me to clear my account and go to a real bank.

    Thanks for the heads-up on this. I've read about it but never actually seen any real figures etc until now.

    That's exactly why I'm doing it, I'm trapped in my overdraft and I can't go.

    You need to write a Data Protecion Act letter and get all your statements. Calculate charges + interest (8% this can REALLY add up). You then state your intentions, give them a chance to reply, then sue.

    It's all explained in simple step by step instructions on the site, with templates for the letters an even an interest calculator.

    As for closing down your account it's EXTREMELY rare, and the site recommends you open another account just in case.

    You can sue them for breaking the banking code, for lying about "admin" fees and for making a lot of money out of people in ways the OFT say are unlawful.

    As for suing like a cheap hussy no. And I don't believe hussies sue.

    I intend on giving the Consumer Action Group 5% of my win if I do (and as stated no one has lost yet - though it'll be my luck to be the first )

    But seriously, you can do it and you can win. It's a long process I started in July, but they count on people dropping out. It's like a marathon, hold on in there. Remember, the banks have a lot of legal power and will put a stop to this soon (as so many are doing it) so get a move on.

    Looking forward to seeing how it goes, I've had my eye on doing this for a while after some incidents with Barclays. To be fair though if you quote this down the phone at Barclays they do sometimes give back the charges.

    Only open another account when you're at the SUING stage. The prelim approach is fine. And as stated it's not a common occurance.
