    query about land ownership boundaries anyone help?

    hi there were hoping to build a house on my girlfriends dads land which hes had for about 15 years and then when mines is built move on to one for him and one for her sister and thats the whole family in a big piece of enclosed land with big walls and big gate in a piece of land that measures excactly 2500m2 and there would probably be enough room to build another house and sell on to make some cash but since he paid of the land 12 years ago hes not paying a mortgage or anything and we would only have to pay for the build and since im a plumber and heating engineer and he is a ground work and foundation and road layer etc were set to save alot of money as we wouldnt have to pay for plots of land he owns all his own earth moving machines and trucks etc and men to do the foundations and layouts etc plus we both know plenty of other trades to get things done cheaper than your average self builder

    so that set me looking at the land and trying to measure its sizes as it is a funny shape and i recall him saying all down the right hand side he built a wall about 2m in from a burn that was flowing by at the time for obvious reasons since then the burn was redirected or cut off im not sure which and about 5 years ago a housing company built a load of rented houses and each one that goes up the right hand side of his land has been built over the old burn/river thing as it was dry and right upto the wall he built so that means theres atleast 5 or six semi's that are on his land and one of the houses is almost touching his wall but he never really bothered as he has more than enough space for his uses

    but i reckon he should possibly be entitled to possible compensation or a sort of rent payment as ive heard this happening with BT poles in peoples land and bt having to pay them rent for using there land

    anyone know if thats possible ?

    either way there definatly without a doubt using his land even if he doesnt get compensated hes not that bothered but i am

    but i spoke to my mates mum who used to be a surveryor or similar and she said either way he should speak to his solicitor and get his land ownership made clear to the company/person who owns the houses just to make sure as after a certain period of time something like 20 years they could probably claim it as theres or have a certain amount of say in the land

    anyone with experience or any advice would be helpfull , im going to speak to the scottish land registry tommorow and see whats what aswell

    If you want to do something about it then get as much proof as you can together and take it to a solicitor as soon as possible.

    It is true that after occupying the land for a certain length of time the other people involved will be entitled to claim ownership. The land ownership laws are quite complex but basically are there to ensure that land is spoken for by at least someone (so not left unclaimed) and any disputes that go back too far to know can be settled quickly.

    yes he has plenty proof loads of drawings from the land registry in scotland and a survey report from 2001 i think that may be when they started building the other houses he got that done just out of curiosity and lots of written pages that say what he owns from what lines etc but it was too dark to start getting the big measuring tape out and going outside and trying to relate the land drawings to what he has built all he knows is he owns land on either side the left side he half owned by him and whoever owns the sort of factory place machining place im not sure what it is but its a good 10 or 15 meter divide but hes not that fussed about that really

    to me it looks like the developers of the other houses chanced there luck and built the gardens right upto his wall and assumed he built the wall where it is and not to his actual boundary as the burn/river thing had gone before they started measuring out the land so either overlooked it or just thought it would be easier/cheaper to use his wall instead of building a wall/fence to their boundary, who knows what they were thinking as it could be very costly if he really wanted to pursue it legally which i doubt he could be bothered with but i say its the principal of the thing and they should atleast give him a gesture of goodwill ..... he even brought a bit of his fencing further up the land further into his own boundary so a tennant could have a square garden , he didnt mind as it was easy for him and it wasnt that much space and the tennant chap is a nice enough chap anyways , and he atleast asked !

    ideally id like to see him get a small amount per month of the offending company as they are making plenty of money of there tennants !

    plus it would sweeten him up more for building our houses if all goes to plan

    its too late to bother to be honest luckily i can read very fast and punctuation etc doesnt seem to affect my speed , as far as i know the alphabet consists of letters only , well last time i checked anyways ....

    and ive got alot more things to sort out and spend time on just now than how i compose my posts in a general chat room with a computer hardware based site

    but next time i use the literary experts forum i will take heed of your advice , i thank you

    because not everyone is a nitpicking grammar and punctuation freak why have you both deviated from the topic ? i see no relevance to your comments and my post if you dont like it then why have you even taken the time to reply to it ? do you get all hot and bothered when you see a post on a casual forum that hasnt been punctuated to perfection ?

    i dont , and wouldnt care unless ofcourse the topic mentioned punctuation

    and are you really that thick and slow you cant read the above posts ?

    you really should start back at school and enter the real world son because if your life revolves around punctuation and you cant decipher a comment thats punctuated and one that isnt then you truly have some serious pitfalls

    you must have a very low problem solving ability and next to useless when it comes to word games , except the big fisher price jigsaw's

    It's all very well insulting everyone else, but you are the one who either cannot or will not use proper English. It takes basically no extra time to use punctation (and capital letters) properly. They must have taught you how to do it at school so why not make use of the knowledge?

    Yes, it's a free country, and you can compose your posts exactly as you like, but the time that you save by not writing correct English is then lost by everybody else who has to read and re-read your posts to try and make sense of them. That's selfish, so you cannot then be surprised if people decide they cannot be bothered to read your posts and help you out. Your choice, though.
