Is there any GC manufacturers that allow you to remove the standard cooling and water cool with out voiding the warranty ?. I am looking to buy a 5970 and water cool so it makes sense to go with a manufacturer that allows this.

warranty is not invalid if you remove the cooler, however if your card dies, and its determined that removing and installing your custom cooler caused it then you may have to pay for the repair
Why don't you just wait for one with a water block attached and save yourself the hassle?
EVGA but they only do nvidia cards.
They have the most open policy, you can overclock the card, you can change the cooler, as long as you don't physically damage the card, if refitting the original cooler and resetting to original speeds does not fix an issue they will rma it.
Other manufactors have a less open policy, they know it happens and as long as you didn't physically damage the card and don't admit to altering it in any way they'll except it.

The other manufactors of course actively try to stop any modification, things like warranty void stickers over screws, Palit are one company who do this, I think Power colour do as well.
The main thing you need to look at is why cards fail, I think you'll find the majority fail due to bad power or cooler failings. As long as you've got a decent psu and the water block cools he card correctly (remember there's more to graphics card cooling than just the gpu) then the most likely reason for your card to fail is physical damage caused by incorectly fitting the water block and no warranty will cover that atm.
