It is annoying and does demonstrate how easily it is for Nvidia to enable or disable PhysX on Ati.

Ummm from that it's not physX on ati, it's just they forgot to put the lockout if it detects a differnt make card (read ati) in your pc, ie you can use an ati card as you main card and a lower range nvidia card just for physx.
it's sooo not a bug just someone forgot to include the extra code
