O2 charging for WAP when not being used

Long story short, my girlfriend has a sony xperia X8 which if anyone doesnt know has an option to disable wap use using a little feature called "data traffic" Now i already setup the phone to connect to my wifi and have data traffic disabled, but for the past few months she has noticed a wap charge on her account, last month was 5p, this month is 9p they are all for "data charge" so is this O2 swindling?

Also lucky for us they have a time it was "used" and just happens she was at work...so not aloud to use the phone when working, Which would of course mean she couldn't use the wap on it.

Any advice would be greatly appreciated!

Are you sure all data services are turned off? Or at least prevented from using the 3G network?

Other apps installed could also be calling home.

100% the phone has Data traffic turned off, it is not possible for any app to update or the web to be accessed unless data traffic is turned back on.

In that case yes, query it with O2.
