    News - Microsoft sweep up Xbox 360 pirates in time for NXE

    Thousands of Xbox live accounts banned apparently. Microsoft usher in the NXE with a clean start.

    Its good that they are trying to sort the pirates out. Bad however when legit users are also getting banned. I think they need to look into what they are doing a bit more carefully. I dread to think what could happen when I hook my console up next week. I only connect to live about once per month to get patches for games and any dash updates as I dont have the wireless adapter and have to hook my router up directly.

    if you were really cynical you could argue that they are doing it just in time to make the banned console owners buy another one to boost their christmas numbers.

    on the other side of the coin how many of the complainers that they have been banned unfairly are trying it on to see if they can talk their way out of buying another console.

    I guess the unfair aspect is, if you;ve bought a 2nd hand machione that has been used to play pirate games, you shouldn't have to suffer the consequences of the previous owner. There's no real way top police that though, and MS no doubt do not support 2nd had consoles.

    If it was sold to you as unmodified yet it had been modified then they've not been honest in their sale and they are liable.

    Depends where you bought it; Gamestation etc aren't going to check that, and you've no way of coming back to the original seller.

    You can't prove that's the case to MS can you which is the main issue.

    Buying something dodgy from a private seller is one thing, but buying something from a retailer is surely going to have some kind of legal backup - you are buying a games console which is sold to you as having the capability to go online and use Live services etc. If the console can't do that (as a result of being modified say) then it's not fit for purpose and you're entitled to a refund/replacement.
