I know its not so simple but if Take-Two REALLY wanted a finished Duke Nukem Forever, surely they should have changed the terms of the contract and funded the project until completion, I just don't see the logic of suing a company thats filed for bankruptcy

Actually i think its makes perfect sense. Take-Two gave them $12m for publishing rights, now losing that sort of money is not good for the investors. So suing them won't get them their money back, but they may be able to get the code and IP as part of the deal and see if they can resurrect the Duke Nukem name into something more than a joke.

I think they are actually seperate legal corporate entities. I seem to recall hearing that Apogee weren't affected by the 3DRealms close...

As far as I can tell there's two companies, Apogee Software Ltd and Apogee Software LLC. It is Apogee Software Ltd (exactly the same thing as 3D Realms) that are being sued and it is they that have gone bankrupt. I think the legal suit is more to do with saving the IP as beanbandit says since there's no money to go after just simply the non tangible assets.

Apogee Software LLC are still running but since they really are a separate entity there's nothing to sue them for since they're not involved in this at all. It would be like someone damaging your car and then you suing the person's son. They may be related but they're not responsible, legally or otherwise. So the only option they have is to sue the company that's closed down and gone bankrupt, there's noone else.

To be honest, after T2 giving them about 12m USD, they only ever released concept art and videos to the public after 12 years. T2 does have a right to sue them, used up their cash and spewed out an end product?
