Quite frankly, I think that the whole idea of "net neutrality" should go the way of the dodo, it's simply not econmically viable to combine "all you can download" charging mechanisms with the idea that your traffic isn't shaped or altered. Companies that provide unecessarily harsh shaping policies will loose out over time via market competition, and I'm sure they'll be more expensive niche companies who will continue to offer "unshaped" traffic.
