These naming lawsuits are getting a bit silly now. The problem is there are only so many English names out there. I guess this is why so many cars end up getting called qashqai and the like.
Also I like the bit about CHACHA being a recognised brand - I'm sorry but I've never heard of it!
When I saw the tag line that Motorola were in legal trouble I though someone might have finally sued them for not updating the Milestone to Froyo. The phone was sold as "Flash ready" over a year ago and is still waiting to be updated to the version of Android it needs, after numerous unexplained delays. If anyone wants to see some angry people head on over to Motorola Europe's Facebook page, where every post they make is spammed with "Grrrr where's my Milestone Froyo!" "2.2 for Milestone!" etc.
You know that you've made it when you attract this sort of litigation.

Silly though it may be (I've never heard of ChaCha either - and let's be honest, who's going to confuse a mobile phone with an obscure search engine? Hell, you could call it the HTC Google and I doubt it'd confuse anyone), how hard is it to do a google search for the name you're thinking of using? It's the first result that comes up!
My thoughts exactly: when my dad asked me to write the website for his new business the first thing I did was google the name, found a bloke in the US who is already using the name, the told my dad "there's already a trademark registered in the US, contact this bloke and ask if he minds you using that name in the UK!". It's hardly rocket science...
Well, Apple and Intel have called their new interface Thunderbolt, which is currently being used by HTC for a phone in the US amongst others.
But regardless of whether law suits are successful, the owners need to pursue them otherwise they will loose their trademark.
Unfortunately it's US Patent and trademark law to blame for all these lawsuits, to keep your trademark you *have* to sue every time you hear about an infringment, otherwise you loose your rights to your trademark and someone else could usurp it...

Never heard of ChaCha before HTC used it.
