    Much as I hate to agree with Florian Muller (Microsoft shill par excellance) in this case he's got a point - if Microsoft can give a no-sue guarantee for WinPhone, then perhaps Google should too.

    On the other hand I don't agree with Rob Enderle - sure Apple and Microsoft signed a deal on WindowsPhone (although some reports I read said it was only WP7), but that's not a free pass. If someone with a WP device, (Nokia?), starts to eat into Apple's market share the way that Android has, then you can be very sure that the Apple legal team will swing into action. So, I suspect that WP makers aren't being sued because they're no threat at the moment - quite the contrary, they're useful as a "example" that Apple's not merely trying to monopolize the market.

    Interesting to see that the Google legal moves have gone up to the ITC, rather than some "hick" US court. Also be interesting to hear whatever happened about that Samsung counter-suit against Apple (over non-licensed use of Samsung technology), since that seemed to be a much more open-and-shut case than the one Apple just won.

    Can't help thinking though that this is a sad, and actually ridiculous, state of affairs to be in.

    Even if Google issued a "non-sue guarantee" for Android, this would not have saved Samsung, it was their own UI elements that caused the problem, not stock Android. That's why Apple was suing Samsung, not Google.

    If there was an issue with WP7, it would be Microsoft feeling the heat, not Nokia, as there isn't the level of customisation with WP as there is with Android.

    Apple's petulant and offensive legal team are a truly disgusting breed of individuals, unrestrained by their senior management like unruly toddlers of parents who find their offsprings' unadulterated greed and antisocial behaviour endearing.

    If only there were some way to express the rage I feel at this greedy abomination of a corporation, I would. :/

    In the interim, I shall be buying Samsung products where possible, and continuing to tell everyone I know about my experiences with Apple hardware, which have been diabolical at best. Thankfully I haven't spend any of my own money on Apple - I shall be trying to offload my work machines and replace with decent hardware running a proper OS as and when I can.

    So what you're saying then - is that it's Samsung's fault for going with TouchWiz rather than stock Android? That being the case, they could have saved themselves a lot of grief since the ICS UI is actually pretty good.
    Oh, and presumably if Apple had sued Google (it's gotta come) then Google could countersue with the MoMo patents.

    Yeah, pretty much. Apple haven't gone after HTC, Motorola or any other Android handset vendor for the same things (just different patents etc.) because they don't use TouchWiz.

    to me that's the elephant in the room. Apple have gone after just about everyone except Google. That would be an interesting one, they wouldn't have home court advantage there.

    As a self-confessed Nokia fan I've got to ask ... what's wrong with WP7 phones? I had a look at a couple of Lumia's and they looked pretty snazzy. More stylish than the iPhone 4S(spit) and the UI seemed pretty clear, clean and quick.

    Put it this way, if I didn't already have an investment in Android (and bought an S3 when it came out) then I probably would have got a Lumia 800 or 900. And I know that there's folks here on Hexus that are definite WP7 fans.

    i myself am a windows phone fan and this comment is just ignorance on someone who doesn't use windows phone, and i myself own the lumia 800 and it has to be one of the best phones i've owned tbf

    I had a play with a windows phone the other day, and I might end up replacing my iphone4 with it.

    I wish microsoft had called the phone OS surface or something, as despite what Microsoft may think about leveraging the brand "windows" it drives many people away.

    Most of these copyright laws are a joke... a joke that vile companies like Apple or Microsoft use to keep their proprietary money squeezing grip on their customers. I think copyright laws should be revised completely to eliminate any monopolistic and corporate fascism behaviour. Basically, copyright is good, but in the real world it's just a tool for the monopolists to get by more easily.

    Google already knows Apple targeted Samsung because of Samsung's increasing market share, their "values" are complete bullcrap, as soon as Apple finds itself doing the same with Google it will. The only thing now is for Google or Samsung to "innovate" the next cool thing and block Apple from "copying".

    The only thing Samsung copied was style and what was popular at the time. Nothing Apple "innovated" was copied, because you can't call it copying.. Apple came into the market with something better and improved than the rest, not something innovative. If you argue that that is the same thing then you automatically give Samsung the pass, because the SG2 was essentially Samsung's version of keeping with the times and what people want and are into. What did Apple expect Samsung to do? Just wait till black stylish rectangle phones are not popular anymore? Anyone who agrees with Apple with this case should ask themselves this question.
