"A Reuters news report suggests that Apple also wants the sales ban to extend to include the best-selling Samsung Galaxy S III."
I just have to say, that made me laugh... Apple really think a court is going to ban it's main competition from being sold, while the Samsung Galaxy S III looks nothing like an iPhone? I've never really been a fan of Apple as a company but I own an iPhone 4S because I personally prefer iOS to Android (and I'm not here to argue which is better) and also like the design of the iPhone 4/4S, but honestly, this makes me feel embarrassed I own an Apple product, because I do not support their actions what so ever.
Heres a good article showing how the jury decided on the damages, and why this might reduce the amount: http://www.fosspatents.com/2012/09/s...rrived-at.html
You wot ? You want $700mil more ? Really?
The age old saying comes to mind. If you can't beat them, sue them.
I have gone off FossPatents, in an attempt to prove that Apple have not patented rounded corners he claims that Samsung infringed multiple Apple patent claims being (a) rounded corners (b) having a rectangular screen centred in device (bit like my TV then, and would you ever have the screen off centre) (c) thin bezels (again just like my TV) (d) front face substantially free of buttons (just like my TV).
Based on this most TVs appear to infringe Apple's designs.
Also the jury foreman's reasoning for the decision is, as has been pointed out on the web many times, simply legally and technically flawed.
Oh I do hope so - it'd be nice if the whole sorry thing got thown out and Apple got nothing. So far things have gone Appleās way in the San Jose court, is it now pushing its luck too far?
Personally I find the idea that they're trying to "extend" the decision they got award verging on contempt. And - as the article's picture shows - anyone who's too stupid to be unable to distinguish an S3 from a 4S shouldn't be allowed to have either (nor matches or sharp objects either)
Problem with that site is that it's Florian Muller's (apologies if I've spelt his surname wrong) and Herr Muller is pretty well renowned for taking the side of big business against Free and Open-Source Software, (which makes his blog title very ironic - who said Germans have no sense of humour?). Note that even Florian is saying this is a wrong decision - in which case it's got to be pretty bad.
Given the acknowledged faults in the original trial and now the award, I would have thought Samsung's appeal to get a retrial eminently sensible and reasonable. But I admit to a slight pro-Samsung bias since I'm an S3 owner.
Crap like this makes me hate Apple even more and i wouldn't care less if someday they totally screwed themselves and went under. I'm hoping both Samsung and HTC get their fair share from Apple over this whole LTE thing.
They probably want the extra $700mil to pay for the LTE case
I think Samsung lawyers were cr*p, these guys didn't even have or show the samsung devices vs Iphone or ipad in their actual form to the jury, so jury could hold and see for themselves... Samsung should hire anther firm if it wants to win... the company representing samsung made so many armature mistakes, it was shocking e.g. some info could not be shown to jury bcoz it was filed to late, or wasting all their time on silly things and in end ran out of time, some samsung lawyers couldn't even identify a samsung phone from an iphone lol. I think people on the INTERNET, websites had put together a better case than samsung lawyers.
Haha. I actually wonder if these two major companies will ever give it in arguing about design and copyright protection ;D
