In the UK at least they are under obligation to state "This is an adervtisement / paid product promoting" or similiar since they are receiving revenue for the upload.

How long until the Advertising Standards Authority steps in and slaps youtube / google around. Simply not soon enough!!

Is this really such a big deal? Many youtubers advertise products and services on their channels. No where does it say that it must be a journalistic piece and to be biased towards the xbox.

The only requirement is that a video containing gameplay and mentions the console it is being played on which could be a release roundup for games comming out this week, hell, it could even be a video critisising Machinama for this very thing with gameplay footage in the background.

Just about every marketing trick in the book is legal in 'Murica. And even if it weren't, the US government is too hopelessly corrupt to even prosecute any major company for anything. Especially since Microsoft's continuance could be seen as a 'matter of national security', due to their widespread deployments, in both civilian and military installations.
