I do believe Atari have every right to sue here, however, the timing of it is oh so convenient given their recent investments, a windfall from nestle will help catapult them back into the game, so to speak.

I was just thinking, I've been seeing this ad for ages and they've only now decided to sue?
Kinda makes Atari look like nothing more than an angry little baby, to be honest... not really good for corporate image.

So what happens if Atari wins and Nestle pays them in KitKits?? That would be sweet revenge by Nestle.

I believe that Atari is a zombie brand now like Agfa. Bought purely for the good will and any IP.

Agree on the pettiness, but it's hardly irrelevant - more clones than Tetris, and pretty much a genre on its own.

Struggling to see why Atari should even care. If anything it's free publicity. Atari could just exploit it, release a new version of the game, shove in bricks that are chocolate bars. All this over a game which is just Pong plus lots of destructible bats.
