    Apple's the biggest name in MP3. So, take aim...sue!

    According to seattlepi.com, a Lousiana man is suing Apple about the potential hearing damage that might be caused by iPods - even though he doesn't claim to have suffered any himself.

    However - and without wishing in any way to diminish the seriousness of potential hearing damage - the class action we'd really like to see brought against the ever-vociferous Apple is one that puts a stop to all the noise the company makes about iPods!

    Yep, I would like to sue him for being so completely stupid.

    It's like tyrying to sue a train company, because someone might get killed if you jump of a bridge onto a track.

    After a quick meausre of all the mp3 players in my house all of them can produce noise in the 115dB range. In fact all of my audio equipment probably can. This is potentially the stupidest case to come out of the US courts since some people tried to sue macdonalds for making them fat.

    The fact is that these people try to convince us that we are all sheep that follow the advertisements and will do all the stupid **** that a monkey wouldn't do. If you turned it up that high it would physically hurt you and you would either pull the headphones out of your ears or turn it down. Unless that is assuming your arms are to fat to reach the iPod because of all the maccy ds you've been eating

    Thanks for doing that research - it's great to have some hard facts!

    But, even without those figures, I'd have totally agreed with what you are saying - and that, of course, is why I highlighted the case in the first place.

    I think it's probably clear that I'm not an Apple groupie - nor, hopefully, anyone else's groupie - but this did look to me like being very much a, "let's see what we can take Apple for" kind of a suit.

    I think that the give-away is probably the bit about the bloke wanting to turn it into a class-action suit!

    And, that's why the subject line for this thread is:

    I'm going to sue the makers of hammers. They have a high potential to damage my finger. I'm going to insist that all hammers in the future be made out of rubber. Grrrrrrrrr why is no-one responsible for their own welbeing these days? I hope the judge in this case finds for Apple and imposes massive costs and damages on the c**t who is taking this action. Knowing the USit will turn out the opposite.

    I'm not an Apple fan - I think the ipod is a load of crap and would rather spend my money on a decent sounding player.

    while this shouldn't turn into an 'is the iPod any good' thread, iranu - the iPod is no worse sounding than an IRiver or Creative player, if somethign sounds crap on it, encode it better or use some decent headphones..

    The volume issue? Well there isn't one is there, it's just stupid. I have a US iPod (without limits) and I use it at ~90% volume most of the time. It needs to be this loud to drown out the sound of the traffic as I walk to/from work. I can imagine this problem being even worse in the USA in a big city like NYC, so I think the volume is justified.

    What's even more stupid is apple limiting their european players (afaik even UK players now have a software volume limit, the player can still make the noise if you put on iPod Linux etc though). Sony did it with their CD players a while back, but it was user toggleable via a switch on the bottom, and the 'safe' mode was far too quiet to hear much anyway. Fine if you have poor headphones or certain types of music, but if you have a decent set of headphones and some music that needs to be played loud (most metal for example sounds crap at low volume) then you need the extra db..

    This just serves as further reminder that while I may moan about the state of some things in the UK, I'm glad I live here and not in the US.

    I just cannot believe that:

    1) their judicial system lets any idiot like this raise this sort of action
    2) that same judicial system actually has the resources to hear this rubbish instead of trying accused criminals
    3) that the people in charge of these suits can keep a straight face in court.

    Every time I hear something like this I think of Grand Theft Auto, particularly Vice City. In the radio (on the PS2 version at least) there's an advert for a fictional law firm where the blurb goes on about suing people because "... only in America, where you can sue pretty much anyone for pretty much anything - and you'll probably win." How true. I guess Jack "spawn-of-satan" Thomson probably took that to heart eh...

    What I'd like to see is someone turning this on it's head for the greater good rather than simply grabbing 15 minutes of fame and as much cash for as flimsy an argument as possible. Say, for example, suing firearms companies in the US for fiscal damages (which are then paid to charities supporting the victims of gun crime and their families) and a complete, union-wide ban on the sale of firearms. That could sort out a massive problem over there out in one fell swoop, but can you imagine the stink it would cause if we *gasp* asked all americans to give up their guns? I'll go and flay myself alive for even thinking of such a ridiculous idea now.

    Or indeed, how about sueing the US "legal system" (note there is significance in the quotes) for wasting millions of dollars on cases like this which only really serve to make a mockery of it's self and freedoms and civil liberties that very nation purports itself to be the world champion of. It's utter horsesh*t. You get better freedom of speech in Russia than in the US these days. Bet that one would stick in a few throats on Capitol Hill, if they could get their head's out of their "asses" long enough to listen.

    Sorry, if there are any Americans reading this please don't take it to heart - just do yourself a favour and emigrate while you still can. Someone will sue all the airports because they're too noisy soon and you won't be able to get out. I hear Moscow is pretty cool this time of year...
