    We want you to return your Xbox 360's say Lucent

    Bizarrely, Lucent have demanded that Microsoft recall all Xbox 360's.

    Check out the Headline for more info.

    That's er, nice for them.

    I suspect the only thing they can do to kill them is to get them to shut down XBOX Live...

    It won't ever happen like that, no judge will impact the end consumers with requesting a recall. Even so i'm not certain there would be any impact to UK users, as lucient might not even hold the worldwide rights to it.

    It's a publicity thing... now more people know about Lucent's case against MS.
    PHP Code:
    $s = new signature();
    $s->sarcasm()->intellect()->font('Courier New')->display();

    Very true, they seem to like drumming up publicity, and suing huge corporations seems like a leisurely past-time to them.

    Can you imagine if that happened? Tons of birthday and Christmas presents being forcibly removed? Ne-e-e-e-e-e-e-e-ver gonna happen. The consumers associations, amongst others, would have an absolute field day

    Well, that'd never happen anyway; but it's entirely possible that injunctive relief could be granted, preventing MS from shipping more 360s, and in the event of a trial going Lucent's way that the 360 could be pulled from sale completely pending MS securing a license to use the disputed decoder.

    um... surely it's the MPEG2 LA who should be sued here, not one random MPEG-using device?

    and the mere existance of MPEG2 indicates prior art, no?

    Not if the implementation uses Lucent IP. Then it would be anything BUT random.

    The Lucent patent dates from 1993; it refers to a particular method of coding and decoding, which Lucent patented and which it is claimed the 360 uses.

    As to Xbox 1, Lucent was previously sued by MS, who sought a declaration of non-infringement, which they got, but only because of a typo in the Lucent patent. It was made clear at the time that Lucent could get this corrected with the US Patent Office and then bring an action subsequent to that. That's what they're now doing.

    I think that any company who tries to sue a games/console manufacture and then demands that all consoles should be (literally) reposessed has
    1. far too much time on their hands, and is being a bit petty
    2. is selfish, who sues a games company..(unless they've stolen your brilliant new idea)
    and
    3. hasn't really thought about the number of complaints that they will receive from avid 360 fans everywhere..
    well thats my rant over..

    They got round it by arguing that the definition in the patent was not what they were doing, basically they took advantage of a typo. Since then that loophole has been fixed
