That is the chipset cooler from the DS3 so it must be at least gigabyte(they use it on a lot of boards). It also has the same solid state caps as the DS3 and in the same positions around the chipset HS. Looking at my board from the same angle they seem identical and I am not aware of any new releases that use the same cooler with solid state caps.
I reject your reality and subsitute my own.
I'm going to go for the DS3 although the layout of the picture is the same as the GA-965P-S3 apart from the S3 has red caps

The dead giveaway on 1. is the lack of the passive cooler found on the XFX 7950GT.
