Makes no sense, how can you convict someone of modifiying the hardware? Its not his responsibility what people use it for.
Take a chipped Xbox with XBMC for example - it doesn't have to be used illegally, its just a lot of people do.
Right this guy goes to court, but the hundreds of eBay scammers and companies like the much vaunted westavon-systems go unpunished.
