    Some advice re: faulty product bought from amazon

    Hiya,

    I bought a remote control helicopter before christmas and used it for less than an hour before it stopped working.

    The bottom propellor stopped spinning and it fell to the ground.

    i`ve contacted the seller regarding this and he has said that the problem is down to general use and they will not replace it.

    Do I have any comeback to this?

    The copter hadnt crashed until the propeller stopped spinning which caused it to drop.

    I love that - "general use". In other words, the reason my product failed is because you used it. If only you'd bought the RC helicopter and left it in the box... then, then it would've been fine!

    I'm guessing when you say Amazon you mean marketplace? Was it a private sale or a business?

    Sound like a standard Sale OF Goods Act issue.

    Goods much be of satisfactory quality, and fit for purpose, and that effectively means free from inherent faults. If they aren't, then a business seller is liable. For 6 months, the presumption is that goods that fail failed because of an inherent fault, and therefore the SoGA applies, unless the seller can prove it was not.

    Push him. And try Amazon themselves, too, though they may well have no legal liability.
