    Question What rights do I have - Pipex horror story.

    Ok, so not horrific as such.

    One year ago I changed from Pipex 2meg to Pipex Max, I knew my speeds would never achieve 8.

    But the most I got was about 1.9, pretty consistently, my local exchange is not unbundled so its on BT Ipstream equipment.

    At the time my friend who works for o2 support suggested my BRAS profile was stuck, I mentioned this to Pipex and they dismissed it totally. So for 12 months of my contract I've been stuck with the same speed as before I upgraded.

    2 weeks ago I changed to o2 as my Pipex 12 month contract was up, my o2 support friend got a chance to properly look into my speed issues, and yes it does seem for the last year my profile has been stuck at 2meg, the error I suggested but Pipex refused to acknowledge.

    Anyone think I've got rights to demand some sort of refund?

    Probably not, and they'll just ignore you unless you actually take them to court (for which they probably have watertight T&Cs to mean the service they provide doesn't have to be of any level of quality). You're no longer a paying customer and you don't owe them any money so look forward to automated responses and being ignored.

    Such is life. Have a scan of the terms and conditions, that's what you signed up for.

    Hmm, is it possible to take it to a small claims court? that way if you lose you wont have to
    pay out for their lawyers and it will only cost you a small amount.

    If you are now getting 4 Mbit consistently I think you would have a good chance.

    comeon, even the adverts say "up to 8mb"

    who needs to look at the T&C with that in plain english, its the biggest get out clause in history, if you went to court they would probably have a dozen guys charging £500 per hour just so as they could ask for there fee's to be refunded after they printed that out on a piece of paper and showed it to the judge.

    For anyone else using a BT wholesale ISP, you can check your profile speed using this BT site.

    I had a stuck BRAS profile - to be clear there are two distinct things governing your connection speed:

    1. the synch speed with the exchange
    2. the BRAS profile assigned to your line

    I was synched at 8meg, but my profile sat at 2meg. I could see this by checking my BRAS profile (as suggested) and looking at the synch speed in my router. So, even though my line was rock solid at 8meg (i live very close to my exchange), I only got 2meg speeds.

    I've had a BT 8mb line at my mums house for the past three years, it only runs at 256Kb, she won't change due to using it for work. Having spent god knows how long pouring through terms and conditions, I found that BT count their "up to 8mb service" as too slow if it's lower than 128kbs, they won't refund you any money unless you're without the internet for more than two weeks. Pretty terrible, I'd imagine yours would be the same.
