    Been charged for returning a faulty laptop...

    I bought a laptop from an online website. Their T&Cs say: if faulty within 7 days return to us for full refund. if faulty outside 7 days, then contact manufacturer who will repair/replace.

    I returned a laptop within 7 days, I phoned and got RMA number, and they said "if no fault found then we'll take off 20% as a "rebuild / reload" fee", I said fine, I'll return it coz it's faulty.

    Now... gets refund in bank, -20% (of £429)

    GRRR

    Was going to buy from them again... but not now...
    And they'e only open to phone mon-fri and most likely closed on the bank holiday...

    Have video evidence of the fault though.. so will be able to tell them that... but what if they don't feel like playing ball? Where do I stand from a legal point of view? threaten small claims court? go to bank to get full refund (paid with visa debit).

    If they won't help, and I suspect they won't, Visa Chargeback may well be the best option, yeah

    Paid on debit card so no way to chargeback. If they won't sort it out you'll need to go to Small Claims Court. Good luck - and if they don't fix it straight away tell us who it is, post the video on YouTube and link it etc.

    I'm pretty sure under the distance selling regs 'cooling off period' you can have all your money back (minus postage) even if there was nothing wrong with it.

    Not if its been opened. Otherwise how could they sell it again?

    However I would push for a full refund and threaten legal action if they dont as you have video evidence of the fault.

    Not true. Visa offer chargeback on debit cards as a courtesy. Credit cards, it's section 75 legal requirement, but it's still an option on debit.

    DSR doesn't depend on item not having been opened - the whole point of it is so you can inspect goods so it wouldn't make any sense.

    True, but not sure if that's possible now that it has been returned. If we're still within the time period, then that's likely to be the best and easiest thing to do.

    Me ? I'm still none the wiser.

    I'd like to read the T&C's because they cannot opt out of anything which is part of consumer law. It amazes me the amount of times traders try to wriggle out of their obligations and it surprises me the amount of time they actually get away with it.

    yeah i wanted to give them the chance to resolve it without badmouthing them. but i am being quite factual in the content i've posted. they are saveonlaptops they also are called box limited

    Terms + Conditions:
    "To accept goods simply begin to use the product. It is important to note the Distance Selling Regulations (DSR) does not mean “14 Day money back guarantee” or “try before you buy”. If a product is returned outside of DSR but within 14 Days of Delivery a restocking and/or restoration charge will be enforced."

    They do not state how much the restocking is on their website.
    However, there is no way to know whether an item is faulty without trying it.
    Surely you have to boot into windows to check all the functions of the laptop are working. The fault is with the external VGA display flickering. So without booting into windows I would not have known there was a fault.

    Those T&C's seem like alot I've seen. Full of stuff they cannot possible enforce.

    Sadly the chances are with a fault like that they may well get away with selling it to someone who may never connect it to an external monitor.

    I would write to them with full details of the order and stating that as it was faulty you want a full refund or you will have no option other than to make a claim using the small claims court. State that they need to reply within 7 days, Send the letter by recorded post.
