Problems With Audigy 2 ZS?

Hey people. Im jsut wondering i have the sound blaster audigy 2 ZS card which supports EAX correct? Well how come when i paly games, eg Rome Total war and u go to the audio settings and select EAX 3 that u get no sound? I mean if the main thing on these cards is EAX then why doesnt it work? I have the latest drivers installed (not that this makes a difference cause they are still full of bugs as creatives drivers are a joke).

From what I remember the cards are EAX 2 compliant, I know there is an update from Creative that allows EAX4 via software, might be worth a try.
