how much would you charge to take such a photo and provide it for use?
£500? tad more?
Work out what the daily rate would be for the use so far....
120 days ?
lets assume the image on their website would be useful for a year....
£500/365 days
thats £1.37 per day
120 days use so far x £1.37 =£164
plus
£100 for improper use
and they will get another invoice in 90 days
Charge interest at 2% per month, flat.

I'm not sure but I would look at sites that sell high quality stock images. Find a few that match your photo and then adjust the price manually +/- to your liking. I would definitely add an improper/illegal usage fee to it. And make sure you back date it from when they started using the image/when you found out.
Still no response, so it's invoice time. Does anyone have a good template to use they can point me to?
Thanks folks,
Rob
Sorry can't help on the invoice side of things, but I would suggest creating a company/business letterhead to put on the invoice and accompanying cover letter, I also think it would be a good idea to send it recorded delivery so that it has to be signed for at their end, that way they can't deny ever having received the invoice.

Lets be honest.. if I ran a small web firm and used a photo without asking and then got a request to take it down from the owner and did .. I'd not volunteer any dough.. even when the first invoice arrived.. I'd wait until some from of legal action began.
it's (sadly) quite normal industry (lack of) standards in the cut throat world of not giving a crap abot other people's efforts.

Sadly very true, so you might want to consider how far you are prepared to go. Are you prepared to take this as far as the small claims court (or Scottish equivalent). It isn't that expensive, but you would need to do some groundwork, licence conditions, when and where you took the original etc. that said, they may not contest a court case, and if you win, you can claim back your odour and research costs.
Is the organisation a public body? That might work in your favour.

definitely take this to court! you need to be compensated for the use of your image (and by not doing so, telling others that it's ok to steal images) - do you have a twitter account? i'd be posting daily about this on it if it happened to me!

So a quick update... Not a lot has changed.
I tweeted them twice and eventually got a response from o e of their marketing people, called him and he seemed surprised as apparently they get their stock images from the usual stock places.
I forwarded him all the emails etc and haven't heard since, emailed back twice (the last time being today) and will see how things go although it's not looking promising!
