    Discrimination at work

    I seem to post alot of crap about my workplace huh? Anyway long story short, i've been pulled from my post due to a medical condition.

    Is this fair? after i went back to work i had a "back to work interview" and my manager said specifically that i was pulled out because of my medical condition, this is written down on paper and logged and has of course been put on my file. I'm not happy at all although still doing my job i find it selfish of them to do this as it doesnt matter where i am on the floor the condition is always going to affect me for life, they have also had a note from my doctor for proof of my condition aswell.

    Am i right in thinking ive been medically discrimanted agasint? and if so what can actually been done with it or should i just bite the bullet and leave it?

    Without knowing the details, it could be a H&S or insurance thing

    I dont know a lot about this sort of thing, but the only question that comes to mind is "does your condition have any impact on your job"?

    Youd also need to consider if it has any effect on co-workers and possibly HSE requirements.

    So long as they inform you that they are removing you from a certain area and inform you as to why obviously it has to be a justifiable reason, then there isn't really an issue, so long as it doesn't break your contract.

    without knowing what your job involves and what the T&C's of your contract are, how long you've been employed, what the medical condition is, and whether it's a registered disability or not, no-one will be able to give an accurate answer unless they are good at guessing

    employers have a duty of care to employees, and if someone has a medical condition or registered disability they may look to make reasonable adjustments to help the employee

    if it's not a registered disability, then it's unlikely to be illegal discrimination

    i suggest you give ACAS a call unless you want to divulge a lot of personal information online, and even then, without seeing the full T&C's and any related documents such as absence, health & safety, disciplinary and grievance procedures, and things like driving procedures if you are a driver, you aren't going to get an informed answer

    How is it discriminatory to record that you were unable to work because of your condition, or that they felt you were hindered from performing your role because of your condition?

    The disability protection rules means that by acknowledging this, then they have to provide either measures to ensure that you can overcome your limitations OR provide an alternative role for you at the same pay level that better suits your needs.
